Please help with my contract

Hey all.

I have a T Mobile Pulse and it is crap.
My contract expired in April, so I went sim only as there were so many dualcore phones out in the near future.

The sim only 12 month contract was sold on the basis that I can break the contract at any time if I upgrade to a better contract including a phone.

Had an arguement with them on the phone as they want £80 to break my contract (which is just £7.50 a month for 12 months) in order to upgrade.

How do I sort this? The contract terms were made very clear to me and I am quite annoyed at the person I just spoke to on the phone.

You hav'nt really a chance, you're locked into a 12 month contract unless you buy it out regardless of what they might have said at the time.
 
Ok so what did they say to you over the phone? This way we can get an idea of what it is you said as well.

I double and triple checked that I could break the contract at anytime if I was to upgrade to a more expensive contract with a free phone.

The issue I can get around as the sim only costs **** all and buying a phone myself would work out the same price.

I suppose it is a lesson to be learnt on my part.
 
It wasn't long ago so it would be worth raising an official dispute and asking for a recording of the calls to prove your case, they are bound to be recorded.

Also if possible record all the calls yourself from now on.
 
If it was a SIMO 12 month contract did you honestly think it was not for 12 months? If it was for a 1 month rolling (what you're implying you were sold it as) why would it be called a SIMO 12 month? Are you sure they didn't say you could upgrade as long as you stayed with the network and upgraded through their sales line?

I did not imply it was a rolling contract. The terms were that I could break the contract if I upgraded to a contract with a phone. E.g. Break the contract for the sim only to upgrade to a £30-40 a month contract for 24 months with a fancy phone.

After a long arguement on the phone they tried to fob me off with an apology. I spoke to the person's supervisor and he sorted it out for me.
