Minor Head On Crash, What To Do?

Just after a bit of advice really,

Was on my way to work today not in a rush at all, went to pull into the staff car park which is on a very tight bend and as i was coming round the corner another member of staff was coming round on my side of the road and hit me head on. I felt okay at the time but have a bit of lower back and neck pain now and was sent home from work.

She seemed to agree far too quickly to go 50/50 outside of insurance rather than claiming which at the time I agreed on and we swapped numbers and said we would discuss it at work on Monday. But I took a few pictures just incase and after showing a few people them they think I shouldnt have to pay for anything since she was on the wrong side of the road. The only thing is there is a walkway marked on the road for people to walk in so she says thats why she was over my side.

There is not much damage to my car, the bumper is popped in on the drivers side but isnt marked too badly so should be a cheap repair and I need a new front grill and small bit of plastic.

So I am thinking if this is likely to go 50/50 in the eyes of our insurers then I will just try and sort it out with her as planned but if you think I have a case I might go for it.

Any advice would be great!

Nah stuff that, insurance time tbh. Best outcome = they find her to be at fault, your car is fixed and wallet is in tact. Worst outcome = they judge it as 50/50 and you are in the same boat as you are currently. Nothing to lose.
 
no white line down the road so this could go 50/50 seen it happen before as there is no clear definition of side, I cant quite see how far on your side she is from pic due to the pedestrian markings i dunno could be tough, but deffo go insurance

Its a difficult one imo given that there are no markings and the road is quite narrow. Seems like an accident waiting to happen!
 
Depends if she is willing to play it fair and get it sorted easily outside the insurance? I'd go for this but if the other party changes their mind it can be dragged out and a real pain.

Are the rules different because its effectively part of the private car park? Could you see if there was any CCTV to show exactly what happened?

Also, could she make your life at work hell if you got her back up by going down the insurance route?
 
Sod insurance for a bump that minor. Your increased premiums will probably be worth more than your car :D
 
There is no mirror in place and yes its private property as its the road to the staff car park.

She is willing to leave it outside of insurance and for the costs for both repairs to be split 50/50.

Although I know there is no markings I doubt the crash would have happend if she was at the normal road position on the left hand side of the road.

Not sure what to do though.
 
To be honest she had plenty more room to go over to the left. It's her fault, she was just being lazy by driving straight down the middle. But I doubt the insurance will see it that way.

This is your problem. It will probably go 50-50 if you claim against her.
You *should* inform your insurance as per the terms of your policy, even if you aren't making a claim. I know, however, that a lot of people don't.
 
The bumper is pushed back behind the headlight on the drivers side and is hanging as you can see in the first picture but the car is driveable.
 
I see it a totally different way to you guys.

The way I see it is you've pulled into a driveway and hit a car that was already on the driveway. I always thought kerbs and driveways had an assumed give way. I mean you cant just pull out of your driveway onto a road without giving way.
 
Go through insurance
Go to your doctor to see about your symptoms
Make a claim for that injury - it wasn't your fault, you got injured, you are entitled for some compensation.

This is why you pay for insurance. Let the insurance pay for the repair, and the compensation from the claim should cover your losses. Remember though, insurance claim is not about getting rich, betterment isn't allowed.

I fell off my bike because someone put a rock in the ground and I skidded on it.

It wasn't my fault and I cut my knee. How much £ should this get me? ;)

In a private carpark with no witnesses. Cracking advice there - could end up with a fault claim on his policy over a minor carpark bump.

This is why premiums have increased by avg 35%
