Advice on bad sale.

I sold a set of memory on another forum on Thursday, I posted the item out on Friday.

Now the buyer just wanted cheap postage, i normally only ever send thing out recorded or above. So in the end i settled with the cheap postage to close the deal.

Now come Monday he had already messaged me saying the item had not turned up, by Tuesday he was hinting at a refund, and he has just asked me for a full refund today.

This all seems a little suspicious to me ie asking for it to be sent none tracked then wanting the refund etc so quickly.

The other problem is i go away tomorrow morning, for a few weeks. So how would you reply to his request for a refund. The member in question has been a member for a year, with a few feedback.
 
obviously he has it and now wants as refund theres not a lot you can really do seeing as you agreed to send it with no proof, you should atleast have goit a proof of postage from the post office which would have cost you nothing
 
Tell him royal mail wont class it as lost until 14 days has passed i think. tell him to wait until then.

He wanted cheap postage - he did not want to pay for the insurance of it being delivered. He bought it from you in good faith (this is not eBay). It is his fault, don't refund him.
 
You should always send recorded with proof of postage, unless you absolutely know the person and feel ok about sending as normal delivery with no tracking etc.

I would probably say this other person has received the item but is looking to con you, but then theres no way to prove it.

Only thing I can suggest is going to the post office and take the receipt, but with the method you posted I doubt they will be of much or any help :o

Maybe next time just stump up the extra couple of quid yourself so you have something to fall back on ;)
 
FYI the sender is always 100% responsible for the safe delivery of an item. Therefore you should only use postage with appropriate tracking and insurance. Low value items are fine to be sent with proof of postage only, but you need to retain good evidence of the contents and copies of the transaction.

OP has my sympathy though, most likely a thieving scumbag taking the ****. For eBay or PayPal transactions you lose every time.

And hope the other person can't be bothered to take it to the small claims.
 
tell him you will repost and send a stick with tracking...

odds are he has the memory and just wants to pull a fast one anyway so play him at his own game

I think i will just message him saying I'm going away tomorrow. And the royal mail will not do anything for 14 days, then say i will be happy to issue a refund once i have returned, assuming it has not turned up.


Does this sound reasonable?
 
SOunds reasonable to me. I hardley use ebay now as been scamed soo much I will only send via DHL now as fed up with royail mail even with compensation etc... Ive been trying to claim with royail mail since nov/dec 2010 and they keep claiming my forms get lost in post!
 
make him wait for 28 days. if it 'fails' to turn up inform him you will be reporting it to the police as fraud by false rep or theft by finding. should make him sweat a little even if there is no evidence.
 
I would tell him to do one.

I agree it is the sellers responsibility to ensure the safe postage of an item UNLESS the buyer does not want this protection, has the price of the item adjusted accordingly and agrees to taking the risk of it not turning up or being damaged in transit.

If you have it in writing that he didn't want it to be recorded then he won't have a leg to stand on in court as it is just your word against his. If however you had sent it standard post without discussing this first with the buyer then it would certainly be your problem, not his.

I always send stuff recorded to avoid situations like this ;).

It's on a forum in a private sale, so the ball is totally in my court.

But i have never received any negative feedback in about 500 trades over the years on various forums, so i do not intend to now.

Sounds perfectly reasonable to me as well. The buyer wanted cheap slow postage so he should be able to wait until you return.

Even if you dont send items recorded if you take them to the post office they will give you a proof of posting which enables you to make a claim if the item is not delivered. A bit late now but something to consider for the future.
 
If the buyer requested non insured then he is taking the risk that it doesnt arrive, not you. Thats basically his fault for not paying it and I would say as much, I guess it depends though on what his trust is like as to whether he is playing you or not.
