Advice on bad sale.

This is unfortunate, but you should never post items other than by a recorded method for this very reason. It is never worth it just to close a deal as it can be a greater headache than not selling the item since, you can end up with no item and no money.

make him wait for royal mail to investigate , they dont class normal mail as lost till 14 days and im sure its even longer if you want a claim

normal 1st class is one to 3 days estimated anyway so hes already been a total ass

i bet he doesn't contact you in 14 days...

and remind him that when royal mail investigate they will ask the postman if he remembers delivering a packet/package...

id be tempted to ring his local sorting/delivery office now pretending to be someone from his address wondering where a parcel of your description has been delivered or not, the postman will know if he posted it yesterday

on the other hand it could genuinely be lost... but its suspicious that hes only left it 1 or 2 days before kicking up a fuss , the packet isnt even 'late' yet , nevermind lost

I agree it is the sellers responsibility to ensure the safe postage of an item UNLESS the buyer does not want this protection...
Unfortunately there is no grey area, if there is a dispute the seller always has to prove delivery and cover the cost of lost or damaged items.

I always send stuff recorded to avoid situations like this ;).
caveat venditor! this is the only way to do it. If buyers don't want to pay postal charges the only sensible choices are to either: accept a lower profit in order to cover the postage costs, or refuse the buyer and do business with someone else.

I have messaged him with my proposal.

his response.

To be completeley honest im afraid i dont think i should have to wait that long. Its not down to myself how long royal mail take to pay out. From my point of view ive paid for and not recieved an item which is your responsibilty im sorry to say. I really dont want to get shirty and would prefer to keep it out of disputes etc so as such think its only correct that you issue a refund. If you want to speak with a mod im more than happy to go down that route and let one decide. I just would like some memory to build my htpc lol.

Seems very desperate to get a refund, saying only 3 business days have gone since posting.

He requested slow postage, then immediately gets shirty after THREE business days have passed.

It's obvious to anyone that he's playing a game.

Tell him to wait it out, he asks for slow post he gets slow post, speak to a mod now before he does to express your concerns, I guarantee he'll contact a mod when you're away and you won't be able to respond and you'll end off banned and he'll end off smug with the memory and the money.

And why are you refunding him exactly? He wanted cheap postage no insurance. Therefore, it's his loss if the goods don't turn up. The scam could have worked the other way in that you might still have the memory but have told him you sent it. Would you refund in that instance? No.

Here's a response for you:

"Many retailers, such as Play.com, enforce a 28-day wait for claims of refund/replacement due to lost postage. This is a perfectly reasonable length of time to wait due to the possibility of unforeseen mail delays, rather than the three bsuiness days which have currently passed.

As you opted for a cheaper and non-guaranteed method of postage, I have no option but to ask that you wait for at least 14 days before a refund can be issued."

He can suck that fat one.

even seller unfriendly eBay & PayPal make it clear that sellers are not responsible for postal delays, and make people wait at least a week before opening a dispute.

I emailed a moderator and got.

Correct. Items sent via standard delivery are not considered missing until 15 working days have passed. He requested standard delivery himself and so should stand by it

Thanks

So the buyer has agreed to wait until i come back from my holidays.

He can feel however he wants to about the trade. Just because the item got 'lost' doesn't mean he now gets the benefit of a more expensive insured/recorded delivery.

Play by the rules set by Royal Mail and make him wait.

sounds like a right chancer, make him wait the 14 days see if he is still moaning after that long and as others has said his fault he insisted on the non recorded way of delivery.
