Hi all, bit of a watcher and never really post however I need some advice regarding a parking penalty.

I'm a Uni student living away during term time in a rented house, the house is situated on a road with a residents parking scheme, for which I have had a permit since October last year, during February I purchased a new car and had to send my pass off with a letter to exchange it for a new one with the new vehicle's reg on, this was the 21/02/2011.

On 1/3/2011 I received a parking ticket for not displaying a valid permit, after seeing the warden down the road I spoke to him and was informed that if I contact the parking services team they would most likely cancel the ticket as I was waiting for a new permit. I sent a letter off on the 7/3/2011.

Having heard nothing for 2 and a half months I believed the issue to be resolved, however on 31/05/11 a letter came through stating from the parking services team that the challenge had been rejected and that a visitors pass should have been displayed (I was waiting on these from the parking team as well!) or alternative parking should have been found (no feasible parking in the area due to it all being in the scheme).

Now I feel that their decision is wrong the whole purpose of the scheme is to stop people parking in the street then walking into town, i have until Friday to pay the reduced fee but am considering if it would be worth consulting the Parking Fines Tribunal to dispute the fine?

All thoughts and advice greatly appreciated.
 
Appeal it and take it to independent tribunal for review. Worst case scenario you have to pay it. Best case they side with you as you actually already pay for the scheme and were waiting on them sending new documents.

Make a thread and people there with far more experience than me will be able to help. If you get a chance take pictures of any signs regarding parking as councils need to ensure they abide by the rules for signs otherwise their tickets are void.
 
They'll probably say that until you have a valid pass (whether its in the post, you are waiting on them or not) you shouldn't park there.

Worth getting bent out of shape and contesting though.
 
Cheers for the info guys, i've already challenged once in the reduced penalty time line. Think i might just pay as i don't want to end up paying more, although i believe it to be frankly absurd.
 
I agree. Seems a bit daft that they can't give you a tempoary pass or something you can display while waiting on a new one to stop this sort of thing from happenning ?

Whats wrong with one you can print off from the internet with TEMPOARY written on it thats valid for a few weeks while you await your new one ?

Its shameless money making, especially given the lack of available local unrestricted parking. (where exactly are you supposed to park if every spot is controlled or has double yellows ?)
 
Appeal it. It's a frankly ridiculous situation. The point of the parking scheme is to provide parking for residents and prevent randoms parking there. You are a resident. You are registered with the scheme. The only reason you didn't have a phyiscal paper permit is because they couldn't provide one fast enough due to their (evidently) inefficient and not-fit-for-purposes administrative system. On top of that, what difference does a bit of paper in the windscreen make? Sure write a ticket for everyone without a permit, but to then pursue those who were paying to and registered to park there on the basis that you 'could have parked elsewhere'? '**** off' is what I'd say to that. What jobsworth idiots make these decisions?

This is True, I Took one to a tribunal and lost, just had to pay the reduced cost of the penalty.

This is most abnormal, once you get to the PATAS/TPT stage the full charge is payable.

Most councils reject almost all informal appeals regardless of merit.

Apart from your mitigating circumstances you need to be looking for other points to use in the formal appeal against the NtO. This could be a problem with wording on the PCN (post it up, both sides with PCN no. and VRN removed), a problem with the signs and lines (you will be surprised how many councils cannot correctly paint a parking bay on the road), or a problem with the Traffic Order.

The council need to get every part of the enforcement process correct, so the NtO may raise other issues, it is also worth posting the rejection letter as they often **** these up too. Get pictures of the bay, to include a view down the side and the end markings (both ends) and post it up and also a picture of the upright sign.

Which council? I may already know of a paperwork issue.
