too cut a long story short my brother got a court summons from a motoring offence, but the surname on the summons is spelt incorrectly, so does this make it invalid? where does he stand
 
It does not make it invalid.

He will more than likely have a warrant issued if he fails to show.

My friend was charged with non attendance after officers put the citation through the wrong door. So I doubt they will not be sympathetic towards a misspelled name.
