Jack Straw on Car Insurance

I had someone from East Asia call the house the other day fishing for something. I told them my Great Uncle Bulgaria was passenger in a car crash where Douglas Flint (CEO of HSBC) was driving, but my Uncle was in a care home now partly due to the stress of the accident. They seemed very excited so I gave them Mr Flint's head office contact details to chase up.

Wasnt he a womble, uncle bulgaria i mean, im pretty sure he was a womble :)

The main problem is this

The current “no-win, no-fee” arrangements for legal costs mean that it’s usually cheaper for an insurer to concede a claim than fight it. Add in the growth of “cash for crash” frauds and it’s little wonder that the law-abiding public are being milked as they are.

and it is SOOOOO true, its much cheaper to pay the Claimant off, make the case go away than to fight it. Fighting it will make the legal costs escalate, easily 3 times, 4 times than value of the case.

The other problem is that whiplash doesn't show on scans such as X-rays. Therefore if the Claimant can "act" well in front of his GP/expert then it is hard to argue with it. There needs to be further tests or ways to qualify the injury.

A Ford Ka bounced off my HGV in a recent incident, I was not injured, nor - thankfully - the occupants of the Ka.

I gave my details to the Police who gave mine to the other party, subsequently, I am now plagued with "Compensation" txts for my various "injuries"(!) I suffered in the Accident.

I get a good 3 - 4 per week.

I could easy, by the sounds of it, send a txt back, make a phone call, go along with it & pocket a few £k for my trouble!

It would be laughable were we not all paying for it.

As for Jack Straw, he's so typical of a politician ,formerly in a real position of power, bleating about something that his party did sod all about whilst being in government!

When their in office they don't really have time for stuff like researching what their talking about, actually doing their job, etc :P

I agree with a Labour politician... WTF is happening to me!

That said, during the interview with Dermot Murnaghan I was sat there thinking "Yes I agree with you mate, but you were Home Secretary/Secretary of State for Justice/whatever for 13 years... why the **** didn't you do something about it then?"

I started getting these text messages shortly after someone crashed into my parked car when I wasn't in it? Co-incidence?

I doubt it, I am getting the same thing from three different numbers. Same circumstances, car was hit while parked at work and I was not in it but I am still somehow entitled to "upto £3650 for the accident I had." I'm also being bombarded for compo claims texts for miss-sold PPI for the loan I have with NatWest even though I chose not to take it.

Agree with Jack Straw on this, if anything good will come of it is a totally different matter.

To be honest, I view car insurance as legalised theft and hate the current system in the UK

i keep getting these, I did have a claim last year, telling me i can get £3k for my injuries in an accident where someone ploughed into my parked focus ST when I was sat on the sofa proves these people are sharks!

Even if new laws were passed that stopped all this claim business, do we honestly think insurance premiums would come down?

I just don't believe the insurers want reform.

tbh they only need to do one thing.

Change the law on whiplash such that you can no longer claim for it. Make it such that you require medical proof of serious injury that an x-ray or mri etc.. can pickup.

Straight away, 80 % of these companies business disappears over night. The harassment etc.. will stop because they know barely anybody suffers serious accidents these days.

Referral fees its pointless banning, as well as banning them from sharing information. They should all be adhering to data protection laws anyway, so that just requires better enforcement of existing rules.

And then reform over claims management companies. Lord knows what you'd do to tackle these vipers ...

I think the whole point is that whiplash will never show up on an MRI or X-Ray as it is soft tissue damage.

In spirit, I agree with you but the reality is that some of these soft tissue injuries are bad and although they don't show up on an x-ray or MRI, they are there and are very real in some cases.

I have a soft tissue problem with my foot, it only shows up on x-ray when it is bad enough that I cannot walk, but it hurts me greatly on a pretty much constant basis. Does that not exist because it doesn't show up on an x-ray? As it happens, this isn't anything to do with a car accident but if it was, I would be seriously ****** off as it does affect my life.

My mum was involved in a crash when someone went into the back of her car when she was stopped at some lights, an impact of about 20mph. Today, 7-8 years later she is still in pain because of it. She didn't get anything in the way of money for it, just a lot of very expensive physio which helped but didn't fix it. Should she have just not got anything for what was a very real injury, just because it cannot be detected?

The tests need to be made more stringent or more research done into finding a definitive diagnosis, not to simply outlaw whiplash claims because it is difficult to prove.

All this WILL be yours . . .

I simply can't believe that anyone could object to the Insurance and Ambulance Chasing Industries

All they are doing is demonstrating private enterprise and engaging in a wee bit of harmless and perfectly legal entrepreneurial "wealth creation".

This sort of behaviour is what you have to look forward to now that we have a Tory Government ;)

Suck it up Tory Boys.

Oh christ there he is and completely ignoring the fact it was going on long before the Tories got in power.

Errr lol. Glad the labour government isn't in power then as most of these companies appeard while they were ruining the country ;)

I hope this helps fix the problems we currently have.

I was dealing with my dads claim and it got pretty damn confusing dealing with quick fit/royal SA/ULR and some other lawyer company for one bloody claim.
