Sister's lost bracelet on Ebay :(

Looking for some advice.

My sister lost her charm bracelet a couple of weeks ago in a supermarket. It was reported but they couldn't find it. Worth about £500, but sentimental value much higher as it had charms bought as presents for her by various members of our family. A couple of them were bought by her fella and given as gifts from her dogs (yeah yeah, I know) which she loved to bits. One of them died a couple of years ago, and the other passed away last week, which makes the loss a bit more hard to take for her :(

I found out today that it had turned up on Ebay, but unfortunately the auction had ended by the time I got home from work and found out. Police have been informed but I'm not holding my breath.

Anybody got any idea what the legality of this is ? It's not exactly stolen, but neither is it rightfully the seller's property (or is it ? not sure on the law on finding something).

I've had a quick google to see if I can find any info on the seller, as they are only in the next town to me, but come up with blanks. Any help/advice appreciated.
 
i think the idea of charm bracelets is that they r quite unique,, as said by OP the add different charms to the bracelet over time,, so the chance of some one having the same bracelet with exactly the same charms on it is quite slim
 
can you contact the buyer? might not be hard to explain and say you'll pay the price they paid for it and cover postage. should be easy to correctly describe each charm on it and provide a sob story like "the one with xyz details was bought when our rex died, here's a picture of him, look how cute he is, and this one when my sister was suffering from depression and the bell symbolised her ability to keep going but now she's lost it"
 
Exactly the same charms in exactly the same order on the bracelet being sold by someone down the road a couple of weeks after she lost it. She's owned it for years, she recognised it instantly.

It could be some crazy co-incidence, it's possible I admit, but it's security marked so IF the police get involved then it can be proved beyond doubt anyway.

Also not sure how to contact a buyer on Ebay - I never use it and am completely clueless as to the workings of it.
 
You wont be able to prove theft! but you mite be able to get "handling stolen property" if that.
The seller has to say she/he found thats it!..
It's theft by finding. If you can prove it's hers which is easy if it's security marked. Then it should be easy for police to get it back. Unfortunately it's the buyer who losses out. Unless they can claim back through paypal.
 
Theft is the "dishonest appropriation of property belonging to another". If the person who 'found' it has no legitimate reason to believe it was discarded off then it can still be theft. It's much like losing your wallet and somebody finding it and not handing it over. Still theft.
 
If it is your sisters bracelet it is theft.

surely if it was lost, then it can't be theft.
the police wont get involved in this, just contact the buyer and offer to pay what they did.

edit. just read the other posts, i didn't know about "dishonest appropriation of property belonging to another" ;-) or 'theft by finding'

You should also inform eBay and tell them police have been informed.
I don't see a problem you should get it back.it's security marked, address are easily obtained of eBay. Theft by finding. Should be an open and shut case for the police.
 
You are expected to make reasonable efforts to return it to the owner, eg hand it in to the Police.

By selling it you appropriate that property.
