How old was he? Did he seem dodgy?


not dodgy at all, i sort of know the guy through one of the vag owners clubs and he ages with me(30) so dont understand why he's struggling with insurance (we pay under £700 for both the wife and I in one of the roughest areas of Glasgow

Exactly. If I left a deposit of £250 for a private sale of a car and then changed my mind, I would expect to get the money back no questions. If the seller then told me that he had lost money by taking the afternoon off work and so on I would offer some of the money back.
If the seller told me he was keeping all the money I would consider that person to be a **** head :D

He's quite possibly just changed his mind. I doubt he'd have trouble insuring such a car to be honest.

because i'm not sure where i stand legally, plenty of people in here have bought and sold cars so might be able to give me some insight.

will fire him a text in the morning offering him £150 back and take it from there
 
A deposit can be a refundable or non-refundable. If it is not advertised as either the decent and proper thing to do is treat it as a refundable deposit.

The only use of a refundable deposit is in shops where people secure a product from a shop on release date, which can be sold on easily if they change their mind.

In the real world, it would be assumed to be non refundable.
 
You place a deposit to prevent whatever it is being sold.

Your deposit is then effectively compensation for the seller if you then pull out,whilst the seller could have sold the item to somebody else.

Therefore, its yours, tell him to - politely - get an education & then bog off! :D

Legally, you are fine.

If you wrote a receipt, you would stipulate where he stands.

He has no proof you have even met, let alone exchanged money.

If you offer some back he is more likely to push for more.

Wy did you take a deposit if you were not going to keep it?
 
Jeebus just give the lad his money back. Would the car have sold in the time you took it and the time he called you to say he couldn't take it.

Just give him the money back and save yourself some hassle.

It's not about what the LAW is, its about not being a ****.

If him messing you around had meant that you had to send someone away who was going to buy it there and then, then fair enough but if not just give him the money back and be done with it.
 
I'd not EXPECT it back in his position, though it'd be worth a try ;)

He should have checked insurance beforehand tbh. The only time I'd expect it back is if you (as the seller) had misrepresented the car or similar.
 
What, you mean like leaving a deposit, deciding not to buy the car and then demanding it back?

Not at all.

If it happened me and i asked for it back and was told no (due to losing a sale) then fair enough. But if I was on the other end as the seller and if no one else had made me an offer, I would just give the lad back his money.

If I had left one with a main dealer and it was stated it was not returnable then of course I wouldn't even waste my time asking.
