if the brake has sufficent wear then that is a fail so it depends how much meat is left ont he pads for the light to come on, id have thought a failure will be on its way if the light is accurate
I would imagine the light comes on well before they become dangerous
in the same way the wear mark on a tyre is so far away from an mot failure?

Err. the wear marker is usually at 1.6mm on most tyres sold in the UK, is it not?
Hasn't the law changed on this? No warning lights to be displayed at time of MOT.
