I am hoping for a spot of advice here, first up the picture (anyone please correct me if I am not allowed to post this picture in a public forum?):

Just to be clear I have no intention of lying to avoid the offence. So while it is not clear who was driving from the photo I am not going to go down the path of "ooh it could have been me or my wife we are not sure!" defense.

My issue with this is that I genuinely remember this stretch of road having checked it on Google streetview:

http://maps.google.co.uk/maps?q=50....sspn=0.006295,0.006295&num=1&t=h&vpsrc=6&z=15

It is clearly marked as a 30mph zone... very clearly! If you check the sign coming into the village it has one I've not actually seen before "Remember 30".

This was a family jaunt to visit some friends some distance away, I was being particularly careful to stick to the speed limits as it is unfamiliar territory. That section of road is memorable as I remember the "remember" sign and I also remember that LED sign a few yards down and it NOT lighting up to say I was breaking the speed limit.

Also I note that no where through the village on that road are there any warning signs alerting drivers to speed cameras - however a quick Google search shows this may not be a legal requirement just a recommendation? If anyone has any definite clarity to add here I would welcome it. I genuinely believe I was doing 30mph through this Village, it was one of those country roads that goes from NSL down to 30 as you pass through each of the villages.

On to the photo, I am not an expert on the different types of cameras but this is obviously not one fixed atop a tower. Specifically you cannot see any white lines on the road (or the road at all) to independently confirm the speed I was travelling. The wording on the notice for prosecution is:

Sussex Police said:
EXCESS SPEED - 30MPH Restricted Road (Manned Equip) (automatic camera device/speed detection device) travelling at 37 mph

So beyond a photo of my car and some graphics suggesting 37mph there is no other proof? I understand you can request a calibration certificate of the device used to detect your speed? Is this true?

As I said before, I am happy to suck it up and admit yes I was driving and there is the possibility I was doing 37MPH. It is a £60 fine and I am being told I can go on a driving safety course to avoid the 3 points.

I think they've got you there buddy.

Reference the warning sign not lighting up, they break and the plod will merely ask you "What do you think your speedometer is for Sir?"

Busted, tbh. at least you dont need to get points for it.

You could take it further and request calibration documents etc, but then if guilty you would get the points and possibly a bigger fine.

Signs are not needed, lines on roads are not needed. Led not flashing you means nothing.

You got caught there's no way you can dig yourself out. The only way to request calibration certificate is to dispute and go to court, where they will almost certainly produce the certificate and you will then get more points/fine as you disputed it.

They've got you banged to rights with that picture. You won't get out of it.

My only complaint from the picture...is that it is just that - a picture. Without the white lines on the road as you get from a fixed camera you can't verify anything from the picture. I think you can request a calibration cert?

Laser, very accurate and no lines needed.

You were speeding. You know you were and they've got you for it. Suck it up and move on.

There is no simple and easy way to get out of these things (even though some people seem to think there is).

Count yourself lucky that you only have the fine and the course rather than the points.

Just suck it up and accept the punishment.

. I think you can request a calibration cert?

only if you dispute it and go to court and if they produce a valid cert you will almost certainly get more points and a much larger fine. Well you can request but they have no obligation to provide it to you until after a summons.
You can totally avoid points, take it and accept you were speeding. State sucks but you can't really fight it.

It look to me like a photo taken from a police car. Did you notice who was behind you at the time?

think of it like this, it's a £60 lesson to look at your speedo rather than led signs etc. Pay the £60 and go on the course or dispute and risk more points/bigger fine? no brainer tbh

It has been shown in tests that laser speed guns can give a brick wall a speed measurement if used incorrectly. The movement of the operators hands can generate incorrect speed readings for cars too.

I remember a while back someone got done for doing 90mph, and he actually found that his car was only capable of 80mph, so I think that there is a chance that readings from non fixed cameras can be inaccurate,...
