accident - who is in the wrong here?

All,

Need a fresh set of eyes on this situation so I'm putting this out there for comment.

Accident overview:

Traffic light controlled Roundabout with exit for 3 lanes (lane 1, lane 2, and lane 3). Lane 3 merges into lane 2 about 100 yards into exit from roundabout.

My car is in lane 3 heading towards exit. Third Party 1 (TP1) is in lane 2 heading towards exit.

Lane 1 and 2 have arrows pointing straight on into the exit, Lane 3 has an arrow indicating that you can either go straight on or turn right.

My wife, who was driving my car, was heading into the exit in lane 3 going straight on, indicating left to begin merging into lane 2. TP1 in lane 2 starts to cut into lane 3 at which point we make eye contact. TP1 continues to cut into lane 3 so she took emergency action to avoid collision with TP1 by pulling right and breaking. This action resulted in my car hitting the curb on the right of lane 3, which broke the wheel (large curb) and sending the car across lane 2 and 1 and into a BMW.

TP1 continues to drive on in lane 3 and away.

My wife calls me to inform we of the accident and I drive the 3 miles to be with her. She explains to me what happens on the phone indicating that TP1's car was a blue astra.

Police arrived about 10 minutes after the accident, followed shortly afterwards by an ambulance for my wife who sustained lower abdomain and shoulder injury and spent the night in hospital.

About 20 minutes after the accident a blue astra arrives at the scene and a young guy gets out and starts talking to the police. turns out this is TP1. He was giving the police a statement and explaining that he was a "witness" to the accident.

Before I went off to the hospital to be with my wife I spoke with TP1 as I wanted to understand what had happend. He told me that my wife was in the wrong lane and that he thought she was turning right.

OK so that's the overview.

Spoke to my insurance company who asked who we held responsbile for the accident to which we informed them that we hold TP1 responsible and that his actions, cutting into lane 3, caused my wife to move out of the way and hit the curb trying to avoid a collision.

My questions are:

1. why would someone drive away from the scene of an accident and then come back and say they were a witness?

2. from what I have described who is in the wrong?

3. both of the front wheels are broken, the steering dosn't move the wheels, rear offside wheel knackered, near side wing smashed, fog light smached, front bumper broken, bonnet dented, from light pointed out of line..... and that's just to visible damaged. Going from that, what are the chances the car is a right off??

easy answer, car is a write off and no matter what you dont admit liability so you arent responsible.

Anyway, its a car, make sure your wifes ok first :p, it can be replaced, she can't. But TP1 is in the wrong, but unless you have witnesses of TP1 doing the wrong, you ain't got a sonny jims leg to stand on son. Police will be peeved they can't be a name to a fault, and well I don't know about insurance. Your just relying on the driver of the BM

If he's claiming to be a witness, but you believe he is involved in the accident, then you should call the police and tell them he is not in fact a witness and he left the scene of an accident which (in your opinion) he caused.

OK Zoom in on the roundabout. The exit in question is the A331 which is straight up on the map.

Lane 1 has a van towing a boat in the picture. It also has a light blue car in it at the top of the map.

Lane 2 is to the right of lane 1.

Lane 3 (where my wife was) is to the right of lane 2 and merges with lane 2 once off the roundabout.

If you do a streetview at the place where the lane direction markings are before the exit, you can clearly see that lane 3 is a "straight on" or "turn right" lane.
 
Not your wifes fault, can only hope that the other drivers confirm the presence of that blue car though.

Edit: Was this the wife or you? I'm a bit confused as you talk about the accident in first person at times.
 
Sounds like TP1 is the cause, but as your Mrs hit the BMW, her insurance will take the hit (pardon the pun) very unfair, but I doubt you'll get very far trying to pin it on TP1 unless you have any witnesses.

It does sound like TP1 has some form of guilt, why else would they return?

As for the write off, I suppose it depends entirely on what the Mrs was driving......
 
So instead of braking and simply trying to avoid another car she piles it into the kerb, the armco, a different car and the resulting carnage sends her back into two lanes of traffic!!!!

Tell her to just drive into the offending car next time. :D
 
funny... she said that. things would have been so much more cut and dry if she had been hit by TP1 then trying to avoid him.
 
I personally can't see how it could be anybody's fault but TP1, howver as has been said already, unless you can prove that TP1 was involved and wasn't a witness then it will be you/your wife that take the hit.

Hate that roundabout, more so than Meadows roundabout...

whereabouts in Berks do you live out of interest OP?
 
She was driving me 58 plate Mondeo at the time.

I would expect it to be repairable, that said, without pics, its impossible to say....

Yes, she should have ploughed into the fool, alas, instinct is to try to avoid such a situation....

Look on the bright side, she's relatively ok, thats the main thing.
 
Out of interest and in trying to get in the mindset of a woman driver...

Which road direction had she come from to get onto the roundabout in the first place.
