New fence, Neighbour Problem.......

It's a shame you have neighbours that don't agree to it.
So, now you'll have to check the boundaries with the land registry and see who's responisble for the fence.

If it's them, you're screwed and will have to erect the new fence on your land, leaving the old knackered fence untouched.
If it's you, rip the fence down and erect your new one in it's place, bugger all they can do about it unless you exceed the 2m limit or encroach on their land with it.

my parents house had huge connifers in the backgarden that were as high as the house , they had been there for probably 16 years atleast , the neighbours build a conservatory and then whined to the council about the trees blocking the light...

my parents recieved a letter inisting the trees be removed at my parents expense :rolleyes: ...

i chopped them down with a m8 and my mum gave me 100quid :D the garden looked better without them but still it was forced on the house because aparently people do have a right to sunlight
 
They have declined my offer to replace the old fence with the new one as they said it will block out the light to the garden :confused: (I'm paying for it all)
the fact that you're paying for it doesn't seem to be the issue for them, if they feel it'd block too much light then they're within their rights to say no (personally I think it's daft to refuse on those grounds alone...)

i said we either move the old or i run on my land.Answer i got was "put it on your own land then)

I have been very polite thought the process.

No offence but that comes across as confrontational to me.. "either do what I want or I'll do it anyway". Don't get me wrong their response wasn't exactly civil but their backs were probably up by that point..

I would just fire it up on your own side and hope you never need to borrow sugar. Your right in saying their side would look terrible but that's up to them
 
Just a warning, I've not read the whole thread but it sounds similar to a problem one of my friends had with his neighbour. I won't go into the whole story, but they couldn't agree on the fence, my friend decided to construct the new one anyway (old fence was on his land). Next door neighbour destroyed said fence, rebuilt his own fence on my friend's land and effectively stole 2metres of land. Obviously police were involved. My friend is now trying to sell his house but because of the past events, he has to disclose the fact that he has a disagreement with his neighbour. He's had to drop the price substantially and still can't find a buyer.

Calm down, love. The issue wasn't with their conservatory, but they probably argued the trees were depriving their existing windows light which they'd enjoyed before the trees were there 16 years prior.

Sad as it is.. You were hard done by.

the owner of a building with windows that have received natural daylight for 20 years or more is entitled to forbid any construction or other obstruction that would deprive him or her of that illumination. Neighbours cannot build anything that would block the light without permission. The owner may build more or larger windows but cannot enlarge his new windows before the new period of 20 years has expired.

Its a PARTY FENCE, it belongs to both of us. The only light it will block out is to their garden.

I dont like them keep looking into my garden. The current fence is too small and its not ideal.

I will be putting a 6ft 6" fence in place... 1ft gravel board and a 5ft 6" panel.

I have contacted the council and they said i'm within law to put the fence on my land.

The neighbours have said they will rip the fence down if it's put up as a replacement for the existing fence.
As it's a party fence they have as much say in the boundry - so would probably be within their rights.

As far as I can see the only option you have is to build the fence on your own land - nothing at all that can be done about it.

However worth noting that you will still be responsible for the existing party fence, so if it falls down totally you will be required to pay half to have it restored.
So just remember you will own one and a half fences for upkeep purposes.

However.... They have said they will rip down the NEW FENCE, not the party fence.

The Party fence is broken and destroyed, its completly busted from years of neglect. This is th reason for me wishing to change it, i have spent a lot of money sorting the other fences where the other neighbours are happy with the height and look (HIGH quality look)

I want a 2m fence as its anyoying going in the garden having people lookinto my house. I dont want it, thats why ive saved for a higher fence.

The light may make their garden a little bit darker, it may not.

QUESTION: If they remove the old fence say in 6mth time, can i demand they put another fence in its place (party fence). If they dont i can then move my new fence 6@ back into the original boundry???

So, if they do you can either suggest you move your fence into it's place or they replace it (as they destroyed it).

So I mis-read the bit about attacking your fence.
In that case, if its on your land and they touch it it's indeed criminal damage.

Both your posts have given me something to think about and will no doubt help me out.

I will knock at their house again before the fence goes up and see if they want to change their minds. I mean its in their intests more than mine. ITs going to look SOOOO bad their side :/
 
I would investigate if it actually does block out their light then ask the council about it, as sometimes the council have a right to take down a wall or fence built.

Doesn't matter what it blokcs out, if the fence is below the legal maximum, then go ahead and make a nice fence, on your land, which will look well, leaing them with their pathetic ugly fallaing apart fence on their side.
Your value goes up, their down until they sort their eyesore.
 
Do it - i hate people being able to see into my garden. I don't have a problem with my neighbours but we're different types of people and we like our privacy. For the sake of 2 feet they will be losing very little light.
