Yes, which is why the only evidence the authorities use is the word of the immigrant, they definitely didn't think of that when creating the law and procedures.
If he isn't going to tell the Home Office where he is from and they aren't doing anything else to find out (asking foreign governments, checking travel records, etc) then the deportation will never happen, so he can't lawfully be detained pending deportation.Hold on a minute. They are trying to find out his country of origin. And he is withholding that information from authorities (and lying 5 times about it). So they have to give him a house to hold him in whilst he makes up his mind as and when to tell them where he's from?

MPs have accused the UK Border Agency (UKBA) of losing track of a population of asylum seekers and migrants equivalent to the size of Cambridge.

You can't just unilaterally dump a person on another country, otherwise what would stop that country from just dumping him right back? And if you cannot ascertain what country that he comes from, in order to get an agreement to deport him to that country, then realistically what options are you left with?
Take him out into international waters, say 20 miles offshore, give him a piece of flotsam to hang on, and wave goodbye.
If he makes it back to the UK, repeat.
Definitely no legal issues with this.
