What sort of trouble would this get you into? (legal eagles/police related)

Ive got a guy that used to work for us, he left a year ago, he lied all the time and was a bit of a total nightmare, once his lies started to unravel, he chose to leave rather than being fired.

Anyway, this morning I get a call from a garage saying that one of our drivers had been in for petrol last week and said they forgot their fuel card and that he would come back the next day with it, he gave our company name. That was a week ago, he hasnt been back since to pay and the police have been informed.

What kind of trouble could he be in from the police for this? Obviously not paying for petrol is theft, is giving false details to them a particularly serious issue? Would this be classed as fraud also?

Its not the first time he has done things like this, when he left we got a call from a guy who we were working for asking why his grandson didnt his apprenticeship, when we quizzed further, he had met the employee of ours on holiday and he told him that his dad owned the company and that he could get him started, he even brought him down (making the poor kid drive 40 miles on a saturday afternoon) to meet me to sign on as an apprentice of the company.

Other things he lied about, he said his mum and his sister had cancer for time off (they never), he said he had cancer, had less than a year to live (after he had left), was going to have a kidney removed (which never happened) and all stupid stuff that was easy to discover was nonsense. He's obviously quite mad, but this is the first time that he's legally gone overboard.

He's also apparently stole thousands off his poor granny that he lives with and threatened to commit suicide when she threatened to shop him, so she didnt.

Had a a guy called Rick working at my place he did this sort of thing all the time over about 2 years he's spun that many Bull **** stories they all started to come out it was all crap..... he sharply left the company owning alsorts to staff like bits on money ehre and there games he's borrowed off staff etc.... when a few of us rent round his house hi Mum came to the door she told us he'd emergrated to Austrialia!
Stupid thing is i saw in Mc D's two weeks later.....
so mother was a bull ****** and so was he

The one that made me laugh the most was " I used to work in a Ferrari garrage and made 50K commision on a sale of 5 cars to one guy" I just thought to myself then why are you working here on Minimum Wage? tut tut
 
It's theft and fraud. The police will attempt to trace the person and report him to the PF (I assume it's Scotland as IIRC you live in Scotland).

If they fail to trace him they may apply for a warrant so that, if he is checked out by any police in the future, he could be arrested on the warrant to appear in court the next day.


My advice - if you are at all worried about him getting into trouble (as well as having a conviction for theft which is looked at poorly for employment due to it being a crime of dishonesty) then tell him to go back to the petrol station and pay the money. He may still be reported but the PF may not proceed with the case....

Heh we got a guy like that where I work, hes told his family that hes the manager here despite never making it above a team leader role, trots out the same excuse about being held up by what would be an epic traffic accident that would definitely make the news every time hes late. Makes up stories about staying in exotic resorts and all the rich/famous people hes met when on holiday (while his children are posting pictures on facebook from Butlins) and got caught out when making up a story about how he owns a landscaping business thats making him 100s of thousands when work said he'd have to fill out some forms to get tax, etc. stuff changed if he had more than one job.

Yeah its pretty scummy, I did try to call him to speak to him but he's not phoned back so he wont be getting a heads up.

Most likely a fine if it gets that far. He could always take on board some sound advice and pay for the fuel but as I don't know Scottish law very well, I don't know if that would be the end of it.

It would go down as Fraud.

TBH, the police and PF would probably prosecute for this given that he cannot explain his actions as being a simple "mistake" by "forgetting" to pay for the fuel as he made a concious misrepresentation at the outset of committing the crime by stating he worked for a company he did not resulting in a material gain for him and a detriment to the company i.e. classic fraud (which you will know anyway VS)

If he had "accidentally" driven off without paying for the fuel and there were no records of him doing it before then going back to pay tends to clear it up. In the case described by the OP, this is not what happened.



Edit: Although it will probably be a fine, the more severe penalty is having a conviction for a crime of dishonesty which, if a prospective employer does a Disclosure Scotland request, will show up and companies take a very dim view on dishonesty crimes as the basis of trust is eroded before it can even begin. He may find it hard to get employment again.

He left your place of employment over a year ago. Clearly the guy is a male chicken.

You've got a guy? You kidnapped him?

You get a call from a garage today about an incident a week ago? It's been reported to the Police? When, today or last week? Odd that the garage would contact you a week later and before the Police who would be investigating.

They said one of your drivers? Did they not name him as this mysterious guy you seem to own? How do they know it is your guy?

Why would a garage let anyone have fuel without any means of payment? I cannot think of anywhere that would let you 'come back tomorrow' and pay, specially garage forecourts!

The rest of what you say about this mysterious character if he ever existed to begin with is just opinion and hearsay.
