Advice needed premier inn damage in room!

If you sound meek or unsure they will just dismiss you.

It WAS unfit for purpose as the bath overflowed.

As PMKeates said demand proof that all other similar rooms were full for each night they wish to bill you for.

Also you are not liable to replace some skanky worn out carpet with a shiny new one. They should be able to furnish you with the age of the carpet and the average life expectancy of a carpet in their hotel chain. Your contribution should be based on the proportion of life left in said carpet.

Of course going travelling makes this difficult as you won't be around to contest any actions they take..
 
If you checked in you will have agreed to their terms.

What they are doing is fairly standard practice and in all likelihood you will be liable. If you refuse to pay they will take you to court and most likely win.

I would recommend trying to reach a compromise position with them.

This. I would say I'll replace like for like. And since the carpet is unlikely to be new (especially if it smelt after getting a bit wet) I would offer to cover the cost of a used carpet. 50% tops. To pay full price for a brand new carpet is unreasonable.

To be honest i dont think they will get very far.

Just tell them you have no idea what they are talking about.

Go to the bank and inform them not to pay out to the hotel from your account.

Job done.

Let them chase you.

You could ask them to prove

1) The floor was damaged - pics, statements ect
2) It was damaged while you were in the room - maybe it was damaged by the cleaner?
3) The damage HAD to be rectified by spending £500

The documentation needed to prove all this im sure they wont have.

Stick to your guns and just say you have no idea what they are on about and will not pay them a penny.

Also, they should be writing to you formally via soliitors if they want to try and claim damages, not calling you.

Next time they call you tell them you do not wish to talk to them about the matter and they can post a letter.

I dont agree with this.

Just because you agreed to the terms and conditions when checking in does not mean that they can take money out of your account for 'damages' without going through the proper chanels - ie legally.
 
I will just sit and wait for now! Want everything in writing, proof etx! I still can't see how a carpet cleaner wouldn't have sorted it!
 
While on your travels, pop in to another Premier Inn for a night, on arrival in your room, steal a section of carpet. Complain that the part of the carpet is missing and get moved to a new room.

Return home with the stolen carpet and present it to them as compensation for the damage caused.

Alternatively, fill the bath in the other Premier Inn, wait for it to overflow and "slip" on the water. Im sure your film studio has a handy amount of fake blood and makeup you could use to make you look terribly injured. Im sure theres a way to profit from it somehow.
 
Our bathroom has carpet, and I got told of for making the bath overflow and soaking the ceiling once :rolleyes:

I CANT EVEN HAVE A NICE BIG SOAK IN THE TUB? >:X
 
First thing is get a new bank card, tell the bank you lost it, then they won't be able to take any money, have it delivered to your bank then it'll bet there in time for your holiday.

I would agree that the overflow should have been able to cope with the water unless it was blocked, what's the point of an overflow? they will have to prove their loss and also that they mitigated any loss, if they left it for a week and it went mouldy it's their problem.

They wont just replace 2 square feet of carpet, they will replace the whole carpet.

You cant just go round your bank and tell them not to pay something, if they have your credit card details they can take a charge from that as you have agreed to their terms and conditions.

There has been good advise though, a working overflow should drain faster than taps can fill, its more than likely that the pipes are clogged with hair, skin and a manner of bodily products stopping it draining correctly. Their routine maintenance should be making sure that bath's cant overfill so while you were at fault the safety mechanism in place should have stopped it from happening.

Can't you phone your bank and tell them to deny all applications for funds from company X to credit card Y? I've never had to do that but I'm sure I've read that it's possible.
