The finding by the two forensic psychiatrists will help determine whether Breivik is sentenced to prison or psychiatric care. Prosecutor Svein Holden says the report shows Breivik was "psychotic" during the attack.

If that assessment is upheld by the court then Breivik cannot be sentenced to prison for the attacks.

"The conclusion is ... is that he is insane," Holden told a news conference. "He lives in his own delusional universe and his thoughts and acts are governed by this universe."

The two psychiatrists, Synne Serheim and Torgeir Husby, delivered their finding to the Oslo district court on Tuesday morning.
"We have no doubt when it comes to our conclusions," Husby told reporters as he submitted the report.

"It was a lot of work, demanding," Husby said, adding: "He has cooperated well."
Breivik, 32, was suffering from a "psychosis" – a mental state that could alter his judgment leading up to and at the time of the attacks, VG writes.
Their report still needs to be examined by a legal medical commission to ensure that it fulfils all the professional requirements.

The court will ultimately determine whether Breivik can be held accountable for his actions, but it is common practice in Norway for courts to follow expert recommendations.

Breivik has admitted setting off a car bomb outside the government offices in Oslo on July 22, killing eight people, before going on a shooting rampage on the nearby island of Utoya where the ruling Labour Party's youth wing was hosting a summer camp.

Sixty-nine people, mostly teens, died in the shooting massacre and police have said they found 186 empty shell casings strewn around the island.
In a manifesto he published on the internet just before the attacks, Breivik said he was on a "crusade" against Islam and professed his hatred for Western-style democracy, saying it had spawned the multicultural society he loathed..


Now I don't know what the psychiatric facilities are like in Norway, but given their general liberal attitude to justice in general, I would imagine that they would be somewhat preferable to Prison.

What happens if under treatment he is deemed clinically sane again, having recovered from whatever psychological issues he may have....will he be released, or will he then have to answer for the deaths of so many innocent people.

More importantly, wouldn't just the act of taking anothers life in most circumstances indicate that someone wasn't exactly compos mentis to begin with?....and subsequently are not most, if not all mass murderers not accountable due to psychosis?
 
Insane or not insane, people should be treated the same when they murder...by being locked away for a very long time.

As I was reading your quoted news bulletin I was thinking this exact same thing.

There is no question that he's off his head - I don't understand why this should soften his sentence. I don't know how pervasive this is in Norway, but I've seen "prisons" in Norway in a documentary - if most of them are like that, and indeed special fascilities even more luxurious, he certainly does not deserve to go there.
 
Isn't this a good thing? he can potentially be in a psych ward for the rest of his life, where as in Norway there is no life sentence so the maximum if I remember right would be 21 years. So being put away in a psych ward can be a life sentence where as if he went to jail he would be put back on the streets eventually.

Yes, they are.

A non-issue he won't be found "sane" - effectively this is a "life" of containment.

Not really. Whilst we can see a significant amount of the prison population does have mental health disorders a great deal of research points more towards a ASD type scenario where the social norms are not in synch with what one would expect and therefore there is little appreciation for the consequence of actions ie it is easier to hurt someone if you do not really comprehend the emotional impact on them or have to suffer emotional consequence yourself.

He will then be transferred to prison to serve his time. They would do an evaluation every three years.
 
Just because his motivations for his actions are dillusional doesn't mean that he didn't know exactly what he was doing.

Insanity should only be a justifiable plea if you are not in control of your actions.

But according to the Psychiatrists he was clinically insane whilst doing the act, surely he cannot then be tried again or commited to prison for something they found him unaccountable for earlier?

They may as well lock him in a Prison to begin with.

Yes and unfortunately history shows us this is quite common. Sane is only a concept that has a definition in what we find to be normal - if the world around you is crazy well then ...

You have a good point there....I've seen some pretty crazy **** but because everyone seems to be doing it (or at least a significant number) it almost validates their reasoning and thus you have ask, by the definition you gave, who is the crazy one?
 
We normally go through trials for serial killers and then stick them in psychiatric hospitals for the rest of their lives anyway (Broadmoor is not a prison, contrary to popular opinion).

Could any sane person kill and maim on such a scale ?
Sane people can rationalise anything to themselves (e.g. the bombing of Dresden).
