I'd contest it out of principle - why should the BMW driver get it replaced for free when (according to you) he was 50% at fault?

Because if it goes through insurance as a new driver aged 17 he'll lose far more than he'll gain if he takes the pragmatic approach.
 
I clipped mirrors with a car the other day on a tiny country road, bloke put his hand out to say sorry and we both just carried on. (yes it was the sorry gesture)

Speaking of wingmirrors, girlfriend has reported to me that the drivers side of mine has fallen off.

and one of the wiper motors is dead

surely his excess is way way way in excess (lol) of the cost of whatever damage there is to the bmw so however it goes he wants to avoid insurance?

all that would happen is he'd pay the claim through his insurance by means of excess, lose any accrued no claims and have a whacking great hike in his premium for the benefit?

Sounds like he's over a barrell on this one, his best bet is the bmw driver has the sense to realise even a non fault claim knackers your premium.

You don't pay an excess on third party claims.

Fix your mirror yourself out of insurance and don't claim.

Deny liability for the BMW damage and due to the very dubious nature of the claim, your insurance tell the BMW drivers insurance co where to get off.

Thus no excess, no claim, and only a small increase next year (hopefully) due to having to declare the "accident" (as opposed to a claim) to your insurance company

Thats the best outcome from this i can see tbh. Even better if your mates wing mirror isn't actually damaged and can be left as it is.

Even if it does need a repair, its going to be cheaper to get a new mirror from a scrappy than claim on the insurance.

and you said yourself that this will almost certainly go 50/50 due to neither party being easily attributed the blame. So remove your claim of the 50, thus leaving BMW driver to claim off his own ?

It's defective and doesnt operate, so it does.

50/50 = 50% of the costs are paid by each insurer, not that no claim will result. You cannot guarantee they wont handle it that way so its a very dangerous game over what is potentially a very cheap fix.

Knock for knock dates from decades ago, its a common misconception that its still used, because its not.
 
I'm pretty sure it doesn't work like that - in the event of a 50/50 claim it's half of the total cost to repair both cars, no?

So both people end up with a fault claim, even if there's damage to only one vehicle.

i've only ever had one 50/50 claim, and had it explained to me by the call centre person at the insurance company that it effectively meant we both claimed off our own insurance as though we were single parties.

Never realised it was shared 50 % / 50 % like that. I stand corrected.

In my opinion, its a tad unfair if he is asking for you to pay the cost of the repair, as its not clear who had right of way. He had a chance to stop as much as the other person did.

If it was me, I would suggest that we each pay for ourselves.

To be honest, I think it's a bit unfair as well but I guess there's nothing he can do, the guy's got him by the goolies and there's nothing actually wrong with my friend's son's astra so the only payment is going to be on the bmw owner's side.

Just make sure that if he does go to BMW and get it repaired that you ask to see the invoice as otherwise he could tell you it cost £200 when in fact it cost £50.
