In my opinion yes it is immoral to seek pain and suffering compensation when it was a simple accident, **** happens grow up and get on with it.

So if you went for a scan and the Clinician accidentally read your images wrong and then 12 months later you had an advanced cancer, would you say it was a simple accident on part of the Clinician and will you say **** happens grow up and get on with it?

I would be ****ed, don't get me wrong, but how does make money help?

also that case is criminal (maybe) negligence not really an accident
 
Why has a thread about getting knocked over by a car and a broken wrist descended into fantasy scenarios of people dying of cancer?

Short story goes, mum was knocked over by a car in a car park over the weekend and broke her wrist, the lad was genuinely apologetic stating he just misjudged her, fair doos we all have off days and make silly mistakes. Mum has a bad brake and will be in cast for up to 8 weeks and will need at least a week off work.

I have advised her to call his insurance to seek compensation ( he happily gave all details and even rang tonight to say sorry again and say that he had told work Company car) and his insurance company) but not sure what she can claim for. I have told her taxis to and from work (bus is not an option) any losses of wages from work and any phisyo she may need.

I have told her as of yet not to get a third party involved as i dont think its needed.

I'm not a fan of pain and suffering claims but how do you put a price on it and how much do you think is fair.

Anyway - If I wanted/needed to claim. I would claim for the loss of earnings (if any), cost of travel (to and from medical advice) and any medical treatment needed (prescriptions, etc.).

firstly calm down, this is a discussion forum, it seems perfectly reasonable that i should post my opinion unless I have misunderstood the purpose of this fine website.

secondly, again someone getting knocked over by a car in a car park is a long way from a "3 year old get hit by a drunk guy running a red light". and again that person should be punished and the family should have all medical expenses paid for, that seems fine but how does them getting a huge payout help?

He means not getting a bunch of ambulance chasing lawyers involved from an HAVE YOU HAD AN ACCIDENT IN THE LAST FIFTEEN YEARS AND WOULD LIKE SOME MONEY? firm.

As in dont got an ambulance chaser involved, thought that would be quite obvious the way i wrote the details.
 
That's just stupid, imo.

Law = the public morality of any epoch, really. Or, at least, a fairly good representation of it.

Point taken, perhaps I worded it wrong...whats the word I am looking for that the phase "Justice is Blind" comes from.

Rather, to be more specific, my point was OP's claim is not based on whether it passes RickST's moral compass.

Now even I agree with that, and I never said it was. I said I wouldn't think much of her, not that she wouldn't win.
 
i had physio under a whiplash claim. what i would say is, i am starting to regret accepting the first offer (i just wanted it over with - crash happened oct 06, i got compensation and physio aug 07) but my neck still gives me problems now. i settled for a payout and 6 physio sessions.

Would more money make your neck better?
