Dads had a crash, other party not playing ball

That's the exact site of the accident, one from both angles

My dad (red) was travelling in the direction of the arrow on Sat 26/11/11. Third party (blue) have pulled out onto the road and into the side of my dads car (Renault Modus, I know :rolleyes:.) Damaged caused:

The third party was working in the lay-by with colleagues. No witness details taken by my dad (:mad: ). The road which the third party pulled out from is a small access road that is gated 100% of the time. Third party wanted to go out of insurance and my dad agreed to get a quote. Names, addresses and contact numbers were exchanged.

I only found out about the accident today so I dragged my dad down to Renault West (Nearly two weeks later :mad:!!) They've quoted at very least £1,000 (New tyre & alloy, checking geometry, new nearside front door, possible new A-Pillar and respray) and recommended we went through Renault Accident Management.

My dads just come off the phone to the third party and they were shocked with the quote and offered £300. When insurance was mentioned the third party is claiming it's not their fault and they have two witnesses. I'm worried they'll fabricate a story of how the accident happened and try and get the blame put on my dad, especially with two "witnesses." My dad didn't get any photos or even witness details. Very minimal damage was caused to the third parties car (VW Golf MK4) so they could even deny being in an accident.

Any advice? My dad very nearly called his insurer but I explained that it's the third parties insurer that is liable for repairs otherwise if he worms out of blame it'll be my dads insurance company out of pocket and thus my dad gets a fault claim.

This is the exact reason why I don't go "out of insurance".

This seems a simple open and shut claim tbh, he drove into the side of your Dad?

Sounds like the only solution is to get the insurance company involved.
 
Sounds like the other guys being a ***** about it. Have you had any quotes from other garages?

If you went through insurance with him bashing into the side of you on a road like that what are the chances you are fault when you are only driving down a road?
 
Phone the other guys insurance company and open a claim with THEM. Failure to provide insurance details would be an offence if he hasnt done this.

Use your legal protection service (if you have it) to press anything legal. You may need to talk to YOUR insurance company but you dont have to claim through them.

Did your dad get any pictures of the other guys car, i.e. damage on the front of it? If not i fear you could be in for an uphill battle.
 
I guess if you go through insurance they will asses the damage to see in who's favour it goes. The third party is either bluffing about having witnesses or has got a few friends to falsely give statements. I'd go through insurance personally, the excess can't be much for your dad and there's no way I'd let the third party walk away with offering a measly £300.

My dad very nearly phoned his insurance company but I explained how he should always go through theirs as they're very clearly at fault. However, what if the third party claims their car was unsupervised, my dad turned into that lay by and scrapped past his car? Would explain the damage and put my dad at fault.

If we go through Renault Accident Management surely they can check using his reg, address and details whether his car is insured and then persue costs from them?

Nothing apart from a name, address, reg & contact number. I'm very surprised as my dads normally very thorough.

I would phone him and say as your not playing ball I need your insurance details not supplying these is a crime? and you will take it further.

how this can be anything than the other parties fault is a joke

There are a lot of dishonest drivers out there. I was done by one who ran a red light, they told their insurance company I ran the red light...

Get that reg number checked asap for valid insurance. Theres websites that say if a car has a valid mot, theres probably one for insurance too. I know most police cars can check a reg number against a national database for insurance.

If you've been ******* by an uninsured driver without witnesses, you will have a fun old time with your insurance company. I got hit by a guy who gave false name and address.

Renault Accident Management are dealing with the claim. The other party is insured (thank god) and Renault Accident Management will be persuing through the third parties insurer. Let's see what the other party say to RAM.

I had a similar incident where I guy pulled out a road in to the side of me when I was stationary waiting for traffic to move. He was so sure that I was going to be the one in trouble, saying all sorts of stuff, dillusional that it was not his fault.

When I phoned his insurer, they told me that they had actually advised him to take it as a fault claim. Hopefully this guys insurer will see it the same way!

He's a nasty piece of work for pulling a road into the side of you, the scoundrel! :p:D


I'm always left bemused by peeps that think they're not in the wrong when they most definitely and obviously are. I was knocked off by a car driving into the side of me when I was on my bike and he swore blind it was my fault!
 
I had a bloke reverse into me when I was stationary in a car park. He even had parking sensors yet still whacked into me.

He got out and basically said it was my fault. I kept calm and we traded insurance details and then I asked him if he was going to admit liability. He said no and drove off.

Later that night I gave him a call and said it was his last chance to admit liability. He said no again. I then said I was coming to his house and at all costs either way he was paying it and then I put the phone down.

Two minutes later when I just got in the car, he rings me up and apologises, saying he "had to try it on in this day and age".

Never heard from him after that and his insurance did all the work to my car.

I had to force it out of him though (with threats of violence). There was no way I was backing down when I was in the right.
