replacement MB inferior to one RMA'd

hia sent back a faulty Gigabyte X58 extreme Mb to the supplier. they sent it back to gigabyte and its beyond repair. theyre now offering me a refurbished ASUS/P6X58D-E, which to me is a downgrade at even brand new.

theyve also offered me a market value refund of £10+vat. surlely thats a typo??

do you think i should demand a new board of equivilant value to the one i origionally had, which was bought 4 260 pound?
 
They don't have to offer a market value refund.

They're allowed to offer a refund based on how long you've had use of the item.

If, say, the expected lifespan of a motherboard was 3 years, and you've had the best part of 3 years use out of it, a cash refund will be minimal.

You negotiate and get the best offer you can.

As you had 3 years use out of the motherboard you're not really going to get a cash offer sufficient to replace it.

Even if you said a motherboard should last 5 years you've still had 60% of its lifespan so a partial refund would be ~£100 which isn't going to buy you a new replacement.

Check with them and see if the £10 is correct.

If that's all they're offering then see if they're prepared to offer something better than the P6X58D-E

But bear in mind that they're offering a £150 motherboard (assuming it's new) when the cash refund they would have to give you is much less than that even if it's more than £10.

on that front, i;d also ask if the replacement is new as it sounds to me like it could be a return unit or something
 
i believe they have to offer a refund if they cannot replace with the same mb or another with equal specs.

Afaik, thats only if it's is found to be faulty within the minimum warranty period as set out in the applicable regs. After that, it's down to the warranty the manufacturer provides, for which there is no specific legal protection.
 
cheers for help guys. giga man is saying that the offer from my supplier is not what gigabyte would do. hes now saying to give him details on board and theyll either fix it or send equivalent board..
