Hi guys and girls.

My girlfriend has been doing christmas temp work for ever so fantastic HMV over the past few weeks.

Today being pay day she checked her balance to find she has only been paid half the amount she was expecting. She had a word with the manager who told her don't have the money and she will have to wait until Jan 6th (however the majority of the rest of the staff have been paid correctly :confused:)

He then got aggresive when she said that everybody else had been paid a lot more even though they all started the same day and have done roughly the same hours, he then told her to go home and said he was letting her go, she now no longer has a job there (not such a big deal as all the temps are being let go on new years day anyways).

Where do they stand on not paying her the full amount she is entitled to? Anything that can be done to get them to pay her before January?

I believe she signed a contract, she's heartbroken she had planned to go christmas shopping today with her wages but obviously cannot.

tl;dr underpaid christmas, been paid half of expected money told wont recieve the rest till jan 6th, what do?

Thanks for any replies.

Go with her to speak to her former manager, take her rota or other proof of hours worked and a copy of her bank statement of what she was paid. Be calm and don't shout, though extra man points for looking menacing.

Speak to an employment law specialist. They can't not just pay her wages but assuming she has only been there a short period she wont have many rights as an employee so could possibly finish her with little to no reason.

Maybe also worth a call to the HR department?

If they say thay will pay her the rest in January then there is not a lot she can do.
They will just say it was a admin error.
There is no way at store level they can pay her as it can't come out of the till as payment are prob done at head office & with BACs.
Head office will be shut early as it's xmas weekend & no one will care anyway as they have there money.
Only other way to pay her early would be with a cheque but she would not get that till Jan 6th as again it's xmas week.

Welcome to big retail & you are just a number

I won't ever defend HMV, because I tempted there last year and it was ok, however, they attempted to motivate us by telling us that there were some perminant jobs going, so we all worked hard only to be let go lol.

Probably my fault for believing them lol.

Anyways, screw the store manager, from my experience, they want to be there even less than their staff do, my old manager used to just sit in the office and listen to her iPod.

Go to the regional manager or head office HR and discuss it

Have you reviewed the tax calculations on the payslip or just taken a look at the net wage received by your girlfriend and compared that to the other employees?

This really makes my blood boil, call they're HR department and discuss it with them, if they say they are paying her on the 6th of January thou then there is not much you can do.

Was just about to post this. It could be that she was taxed more than everybody else. Get her to check the payslip for the details.

also is it just me or do women still get the massive stick when it comes to dealing with managers in low paid job situations? Or are they just too sensitive?

My girlfriend has had similar problems in the past where she comes home almost crying, personally, I have never been treated in a way at work that would offend me and I would raise hell if some arrogant old idiot stuck in retail in his 50s would try to intimidate me.

Because she's a seasonal temp they will pretty much just use her as a donkey until her time is up. At least that's how it used to be for me and any other temps I've spoken too.

What was in the contract as to when and how you would be paid.

If you are meant to be paid weekly or monthly, they either have to pay you on the day or early if bank holidays etc get in the way.

Use any HMV gift cards that you might get for X-mas as soon as you can....
This... used mine today to get a PS3 =D

I'd say call the HR department as ultimately they are the one's best placed to deal with this kind if situation.

I'm betting she's on energency tax, and the others weren't/aren't because they gave in their previous p45?

What a complete **** this guy is, i hope he chokes on his turkey when he sits down to his christmas dinner. I cannot understand how people like this can sleep at night while potentially ruining someone elses christmas.
