It's not their responsibility legally, however, with theft you have the issue of dishonesty. Theft isn't theft in law unless the act is dishonest. If you got asked but replied no, when you really did have fuel, that is a dishonest act - point proved.

However, if you're not asked, people could use the defence that they forgot or where unaware that they weren't charged the full amount. This would mean that it could be tricky to secure a criminal conviction for theft. This isn't to say the retailer couldn't recover the cost civilly though.
 
just out of habit the first thing i say after saying hi or whatever is the number of the pump i used, therefore i would never be in this situation.

but as already said numerous times, theft is theft.

Although, my friend has forgotten to pay for petrol before and had no consequences... I wouldn't try it though :p
 
I know its theft peeps that's why i paid but i was only asking to prove that my colleague was talking BS, from the looks of it you've proved that point and i can show him this.

I work in the Epos industry and our petrol tills have the functionality to prompt the cashier at the sub total point of the transaction to ask the customer if they have had fuel or not.
 
Is it true that if you forget your wallet, you can get an IOU and pay it within a week?

Last time I left my wallet at home, they did offer to take my address but I declined and said ill be back now, parked my car in their carpark space and left them the keys, I lived about a 15-20 minute walk from the Garage.

So I guess if they offered to take my address, I could have paid the next day etc.

Yes, many fuel stations allow this. After all, they can't exactly take the fuel back can they? I had this happen to me once, so rather red faced I filled out a form and popped back 30 mins later with payment.

I reckon a case like this happens at least once every day in the UK.

They cant take the fuel back but they can require you to leave your vehicle on the forecourt whilst you go to get payment/get someone to bring you the money

We do have no means of payment forms but we can only allow you to fill these out if you have some ID on you such as a photo driving licence. This is so we have your details should you not return.

Its pretty rare that we get someone with no money at all and no ID, usually theres a problem because the customers card has declined.

Itsd a nightmare at times, especially at the end of the month, we have several customers whose card declines month after month so they come back after payday to pay. Sadly for these customers they will now be required to prepay.
 
Yeah you do get an official IOU, I forgot my card once but luckily I lived 2 minutes away so I came back and paid straight away.
 
Yes really. It just gives dishonest people a loophole.

It's that kind of rubbish law tha leads to so many people "trying it on".

You'd have a witness statement from the cashier though and possibly another colleague saying the contrary. That's usually enough.

The dishonesty clause does protect people from honest mistakes that they would otherwise be criminalised for though.

Not as far as I am aware. If someone gives you their name, address and phone number, then that's enough. I don't see any power for you to require them to leave their vehicle.
