I have a friend who is....I'll be honest I might be going for a cosmetic procedure soon, private as stated in title.

What I need to know is if there are any complications afterwards who is liable? Is it me after I sign them papers? Like for example, there is no difference, it is not what I requested or was told the outcome would be different.

Now, I am not going cheap and have booked via Harley Medical Group and have been informed the surgeon is one of the best in his field in Europe, have checked his credentials on the GMC registar

I realise that by starting this thread I am going to have to face a lot of ridicule from you people but please go easy on me :)
 
Contract is between the patient and the doctor and any real issues will be covered by their insurance. Check terms on the contract.

Example, I go in for lipo suction and doc tells me this is how you should look after lipo but after a few weeks I see very little or no difference nor does anyone else.
 
The doctor will manage your expectations in advance and he should give you a honest idea of what the final outcome will be.

You will not be able to take him to court or ask for your money back if for example do not really like your new nose.

however if you go in for a Penis Enlargement and you come back castrated it can be considered negligence and your in the money.

Complications do happen during surgery its a fact of life. People go in to get their teeth pulled out and die. Others go in for a new heart and live 20 years.

That just won't happen, they remove significant volumes of fat. They can only give a rough idea but they'll explain all of that at the consultations. Soga could come into it, and that's what some of the recent boob folk are hoping to use but I'd suggest they cover themselves very well.

You forgot the bit that the Clinician will get him to sign a Consent Form which will also outline the main problems.
If the Clinician thinks he may not be taking it all in he may also draw pretty pictures on his hand written notes and get him to sign the hand written notes.
 
Is this the same Harley medical group who last week stated they will not replace the potentially dodgy breast implants they placed, as it would cost them too much?
In answer to your question, they will do their best, are your expectations within a normal range?

yep no one wants to end up in court and from the sounds of it the OP is planning on how to screw the doctor even before the surgery.

OP if you have an concerns talk to the surgeon.
 
Put it this way - they legally cannot exclude liability through negligence. It's against the law to do so and any such contractual term is invalid.

If they negligently cause you harm, then you can be compensated for it.

It is the same group, I am really on the fence about this one.

They used a product that was licensed and considered safe by the MHRA. They should at least offer a replacement at cost price.

I cant remember the exact wording, but the papers will say somethign like results are not guaranteed, they are just offering you a guide as to what the outcome might look like.

I will talk to the surgeon but to make assumptions that I am going out there to screw the doctor even before surgery is just below the belt. Just be happy that you aint had to go through life as I have and then to save up a large amount of money for a single chance at making yourself better. Thanks. :o
