Two thugs who left a good citizen for dead following a savage kicking when he chastisted them for vandalising a wheelie bin celebrated after walking free from court.

Daniel Chrapkowski punched the air with delight while Thomas Lane stuck his fingers up and squared up to photographers after both were spared prison.

Their victim Joseph O'Reilly said it looked like they had 'won an award' rather than having just escaped a jail term.

The pair, both 24, were part of a gang which battered Mr O'Reilly after he challenged them about tipping over wheelie bins in the street.

Mr O’Reilly was punched to the ground and then kicked in the face. He was knocked unconscious, suffered a fractured jaw and bleeding to the brain and spent a month in hospital where he was forced to have a metal plate fitted into his face.

But Judge Martin Steiger QC, at Manchester Crown Court, decided to pass non-custodial sentences on Chrapkowski and Lane.

A third man, Oliver O’Neill, 23, was jailed for 27 months. O’Neill was on bail for another attack when he assaulted Mr O’Reilly. He was given a jail sentence after he admitted two other grievous bodily harm charges.

In mitigation for Chrapkowski, who is unemployed, defence counsel Katie Jones said: "He is extremely remorseful and wishes to apologise to the court. It is extremely out of character in a misguided attempt to protect his friend."

Very remorseful indeed.

What the hell is wrong with some of our judges?

If we aren't going to put these morons in prison, who are we going to imprison? Actual murderers only? :confused:

People who behave like this should be marched back into court and re-sentenced (or preferably shot).

i thought this a little strange. due to him having no previous i recall so he got a suspended sentence along with the others and community service.

the victim was rightly livid, beggars belief really. was there any point in even reporting the incident?

these type of things seem to be becoming more common place, where the judge can only give a certain sentence because of the law. i've said it before and i'll say it again, maybe it's time to revise certain laws?
 
Is there no form of review body for the judiciary? Surely something like this should cause the judge in question to be reviewed to see if he is actually fit to hold his position.

sounds like justice was served, again its newspaper spin on an otherwise irrelvant story

Taking in part in beating a man half to death should get you prison time.

That 'third man' seems to have only been given prison time because he was already on bail.

The fact of the matter is, these 'men' are going to end up seriously injuring or killing another person in future, this has not been a remotely effective deterrent as you can see.

You do not know that - you are letting your emotions and opinions get in the way.

You werent in the courtroom , you have read one article and come to a conclusion based on I estimate about 1% of the facts.

THAT is not justice and its the reason we have a law and court system.

Im sure that could be said about most killers, rapists and other down right scummy people!

If you take part regardless of been the 'main attacker' you should be given time too. Caught up with 'bad people' or not, we all have free will to walk away or try stop the act. no excuse at all!

he may of took part inthe attack - but you do not know to what effect.
and hes happy he didnt have to go to jail? so what?!? that doesnt make somebody number 1 on the FBI list all of a sudden does it.

Why the hell would a journalist, whose stories rely on interest to be successful, purposely manipulate facts in order to make them appear more outrageous to their readers?

On top of this, why on earth would the journalist's employer, whose success relies on the interest of their journalists stories, then take the most well manipulated articles and publish them with the hope that they shock readers and therefore encourage sale of their product?

Don't be ridiculous. Anyone would think that this is exactly how the news industry is run or something.

No. I for one believe that the judge involved cleary understands very little about law, not as much as me anyway, he was clearly wrong letting these men walk free. It's not as if he studied law or anything. He obviously didn't interpret the facts as well as I did. The facts I got from this article, that is. These facts that can in no way be disputed.
