Hi Chaps

I had a CID officer knock at my door today, asking me by name however I was at work my wife explained. The officer then asked to see if he could come in. He then produced a badge etc...

He then proceeds to ask about my Car (C4 Picasso) and how/ when I purchased it and were are all the documents(finance). My wife hasn't got a clue, so she gets on the phone to me and explains....

The officer then comes on the phone and says to me that the car has 2 finances on it, mine and some other persons, and assured me that they wont take the car from me, but the garage I purchased the car from is under investigation for fraud/money laundering...

So, the garage I purchased the car from hasn't done a HPI check on it or they knew about the finance and chose to ignore it

The officer is interviewing me next Friday and I have to give my documentation to him. What the hell happens now guys???

Do I tell my finance company? am I legally allowed to drive this car? what about my insurance? am I insured as the car belongs to some other finance company?

:(

Sounds like the garage has defrauded the first finance company out of the settlement and lied to your finance company by stating they had settled the first agreement.

I suspect the Police will have already notified your finance company. I'd carry on as you are and continue to pay your finance. In these circumstances I very much doubt the first finance co will come after you in the circumstances.

I am not sure what the next steps are but why didn't you do a HPI check before you got the car would have saved you all this trouble which you don't need. Dealer or not dealer I always do an HPI check myself before parting with any cash.

Yeah, I should have but coming from a garage I thought I was safe.....and they do advertise ALL their cars are HPI checked.

however, during the purchase of the car it was on private plates, and was in the process of going back to original plates....

The finance companies always HPI them, and lately they've started to wait till any previous finance is clear before paying out.

I had a customer wait over a week while a £288 settlement cleared and finance company gave clearance to new finance company.

Makes me wonder how this slipped through then? is it because it was going through a change in plates? and my finance company HPI checked it against the private plates?

You will have some protection under the Consumer Credit Act too.

Effectively you didn't buy the car from the dealer, the finance company did and ownership won't pass to you until the final payment is made. If they don't own the car, they will need to come to some arrangement with the first finance company or compensate you.

I wouldn't expect to do a HPI check on a car from a dealer.

D'oh!

I thought everyone in Cleveland knew they were a pack of scumbags!

I remember walking past the garage when they had 3 police vans parked outside and a load of coppers sat inside raiding the **** out of it.

Who was your salesman?

I think it was Liam. Do you know them?, lol, hope not.... :)

I know Liam hahaha!

Went to school with his girlfriend who is super hot. They have a house in Kirklevington and they are always driving round in the newest RR Sport or Merc and she doesn't work....

Explains where they get the money from.

Oh!

Its a small world, lol.

I wonder what happened then, just checked google and they were raided on the 15th Dec and 3 arrests were made, but I cant find any more info.

I wonder how many more are in the same situation as me. I drive by them on a daily basis and they are always busy.

Not your problem OP.

You dont own the car.

The finance company does, they have bought a car with outstanding finance on, not you, what ever legal problems there are are between them, the garage, and the previous owner.

Just see the nice policeman, answer his questions and carry on life as normal and forget about it.
