Returning a car to a dealer - what are the rules?

Chap I work with has bought a 7 seater Mazda MPV and its got a lot of issues.

He bought the car last Sunday and its been to 2 garages this week who have largely condemned it.

What are his rights regarding returning the car for a refund?

Its slightly complicated by the distance from where he lives to the dealers. We are in West Wales and the dealer is in Blackpool.

It says if you reject a car you must stop using it.

If the garage accepts it back he's going to have to drive it back to Blackpool.

Its not dangerous as such but there is something wrong with the engine and its got a really bad oil leak.

The dealer will no doubt offer to have it repaired FOC and inspected by an independent dealer (usually a main dealer) with no hassle. If not then go down the sale of goods act etc...

How old and how much did he pay?

Its a 2002 Mazda MPV Diesel with 85K and he paid £2.5K. Its bright red too so he's been nicknamed Postman Pat all week.

At the moment the owner of the place won't take his calls and one of the employees answers.

Its got a bunch of niggly stuff wrong that you could put up with but both garages say its down on power but neither have put it on a diagnosis machine. It leaks oil badly. Just being parked in the car park theres a stain underneath it. Looking underneath the car its black! The first guy told him plainly "Its *****"

I'd say you're within your rights to reject, but in reality the dealer will take a lot of pushing and probably a court summons to enforce. A lot of hassle.

A fault with the engine and an oil leak is hardly worth the hassle, get them to fix it.

So it's down on power and it's ****ing oil out nice, Id stop driving it now.
