Yes.

Our insurers (Hastings) have also refused to pay the van driver and his passenger and asked them to claim from the lorry driver. They both put a claim in for whiplash days after the accident. They only hit the car very lightly so the wife was suprised they put a claim in for personal injury.

At this moment the only thing were uncertain of is whether they will pay the van driver and his passenger through this non-prejudice settlement. Need to speak to the solicitors on Monday.

A 53 plate Astra.
She was lucky that traffic was slow due to roadworks.

That part of the motorway at Junction 8 M6 where the M5 starts is really busy during peak hours.

Would this be the usual situation in which the car driver slows to 50MPH and every lorry on the road refuses to reduce their speed from 56MPH causing them to undertake, overtake and intimidate car drivers which refuse to move out of the way.

Glad your wife is okay. Hopefully all the insurance stuff will get sorted with little hassle.
 
I've never heard of a "without prejudice" insurance settlement.

Are they suggesting they'll pay out (presumably to prevent any additional hire car costs being incurred) and will determine liability later?

If they were confident they were not liable, why would they pay out at all? Surely payment is an admission of liability?

What did your solicitor advise?

Solicitor previously advised us to go 50/50 which we refused. I get the feeling they want a quick settlement as they get paid either way.

We had to push them to get the statements off the van driver and his passenger after which the solicitor said do not settle for 50/50. They have both clearly said the lorry diver was at fault.

I will get the wife to call and discuss the fault and non-fault claim bit with the solicitor on Monday and also ask who will be paying for the van driver and his passenger.
