Yet another work-related scandal. Eurghh.

So today, being yet another day of crap existence, I've experienced what I can only describe as a monumental, mickey-taking slap across the face.

So, after serving my 3 months notice at my previous job (they wouldn't let me go early but took away 90% of my work, so i've been sitting there doing nothing for 3 months), I turned up at my new job this morning.

I was immediately told the following:

Employment will be terminated Monday, 19 March 2012

As we have explained in our meeting, the position was a newly created position as a result of internal restructuring. Since offering the position the performance of the company has significantly deteriorated due to the general fall in activity in its key markets. Following the latest set of results and demand outlook, the Board of the company has been forced to start implementing cost savings across all areas of business, and focus on its core business and customers in order to guarantee the firm's long term survival. Therefore we are no longer able to continue with your employment.

You are entitled under your contract of employment to a notice period of 1 week. However, we would not expect you to work out your full period of notice and we will instead give you a payment in lieu of your notice period.

(This works out to 1 weeks pay and 3 weeks ex-gratia payment) - my probation notice being 1 week, but my actual notice was 3 months.

They've claimed they only decided this in the last few days and did not notify me as it was necessary to discuss when I started work (i.e. my first day). :confused:

This of course sounds like complete BS to me and must surely just be the way in which they must do things to protect themselves?

Also, both the company and the agency have denied knowledge of knowing this was going to be the case... i'd spoken to the agency a few weeks before and they assured me everything was ready for me to start etc.

So do they really expect me to believe this is the true reason why they've seemingly changed their minds? I feel completely conned but do not know enough about employment law to know what to do.

Needless to say, after expressing my disappointment and advising them i'd obviously need to seek advice, I left. Total time in new job... about 30 minutes.

Someone help me please :( (and i'm not really in the mood for the usual ribbing please)

I would probably speak to someone at the CAB and see if they can be of any help. If you don't get any constructive advice there see if you can get a free consultation with a solicitor as most of them will at least hear you out without charging you to see if there is a case.
 
i cant offer and advice as i have 0 experiance in this field,
all i can say is im gutted for you.
i cant imagine being in a possition like that.
 
Yeah it's bad, but look on the bright side!

4 weeks paid holiday, and you can look for a job with a company that aren't ****ing morons.

Legally, I don't think that you have a leg to stand on. You were in a probabtion period, they are letting you go and giving you recompense. It sucks but them be the rules :(
 
Sorry to hear this.

I'm not sure why they would intentionally wait until your first day. Makes it much more difficult for everyone. Having said you don't think the reasons they have given are the real reasons, what do you think might be?

No, that's just me being suspicious that maybe they changed their mind or something... i'm likely just being paranoid.
 
That's my biggest worry when changing jobs. You have just left a secure job and because you are starting fresh you are on probabtion and they can get rid of you with no real reason.
Or in this case because the business isn't doing so well.

Don't believe a word a recruitment agent says, they are the scum of the earth.

Agencies use you to just earn themselves money and don't give a hoot about you.

It's russian roulette leaving a job at his time to go somewhere else - unless you already know someone working there who can keep an ear to the ground on how they are doing in the marketplace.

If it where an un-employed person being told this then it would be dissapointing but you'd nevertheless just go back job hunting again but to actually quit another job and then be left with nothing then i'm gutted for you :(
 
Name and shame, protect other people who might get treated like this by them.

I think you are missing the point. The company are struggling and are letting people go, I don't think they will be employing many more people any time soon. You just want to be nosey :)
