Hi guys.

I just sold a car of mine, privately through autotrader. A guy drove to see it, tested it, drove it (upto about 90 mph) gave it a good running. Had no complaints. Cash was exchanged and off he went.

I get a call later this evening saying he thinks the bottom end has gone and he can hear a lot of rattling. I can honestly say in the year i've had the car, it's been serviced, oil checked and topped up, and i've never heard such noise.

He's now saying he's not happy with the car and wants his money back as it's going to cost him £1500 to repair.

Where do I stand?

tell him to get lost, as soon as he drives it away its his problem surely? if it was a garage sale then you have a bit of come back but i doubt you do buying private. sounds like he has trashed the life out of it

Ask him to come around and provide yourself with the warranty documentation stating the terms and conditions of fixing issues after the point of sale

Then state if he wanted a car with warranty he should have purchased a similar car from a main dealer.

You are under no obligation to give him anything, despite what he might protest about what he wants.

Explain that private purchases are sold as seen and that any costs he has incurred since taking ownership are his liability. If he wanted a warranty he should have bought from a dealer as the car was fine when you sold it him. If he thinks there was something wrong with it prior to buying he should have had the AA inspect it if he doesn't have the knowledge to do so himself. The AA will guarantee the inspection as well and offer to fix anything they didn't spot if a garage agrees it was present at the time of the check

He has more than likely drove off and just started nailing it. How long between him buying it and the phone call? just out of interest.

it's a 2001 s2000.

thanks guys. I feel for him if he does have a problem, but i'm not gonna cough up.

Whatever you do, dont allow this to hang around as if its partly your problem. Make it clear that the car was sold as seen and that is the end of the matter as far are you're concerned. Dont offer to help or part pay, etc as you will only cause yourself more issues.

Just realised who this is! Hi Si! (See my Trust)

This many many times. Say you're sorry but the car was sold as seen, no warranty given or implied. The price you pay for buying cheaper privately than from a dealer. Do not even suggest or hint that you will help or contribute whatsoever. As above. Tough ****!

I'd not return his money tbh.

I sold and Accord a few months back, high miler and a bit ropey, the guy came and checked and took it away, after an hour and 25 miles away, phoned me to say its knackered, me being the thicko it was took his word for it, that it just died, and went up and towed the car back and gave his money back.

Turns out the tosspot had been hammering the car on the motorway and the engine had decided to **** itself, I didnt know this at the the time and felt really guilty, and had no need to.

buyer beware and all that

you dont know what he's done to it in the time between sale and the phone call, for all you know he's sat it on the limiter and popped it.

that said could easily be a scammer out to try and get a few quid back on the car.

no matter what be polite and explain sold as seen old chap

given we has waxing on about his dad's murcielago i'm sure he can afford a few quid anyhoo!

This is surely the risk someone takes when buying private?

Its not your issue mate. He's made the decision to buy it after looking at it and test driving it.

Tell him to buggar off!
