Copying someones fleebay thread\description

Hey fellas,

So, I've started selling something generic on that well known auction site.. something that a couple other people are selling also..

I quite liked the description and photo they used on theres...

So, I copied it.

The image isn't copyrighted (as far as I can tell)

But, the original chap has sent me an email saying:

"STOP COPYING OUR LISTING

You have been warned"

Now, can he actually do anything? Am I going against the rules or anything?

Why wouldn't you do that? I used to copy listings and add a little extra. It's so much easier when you can't be arsed doing it yourself.

... your knowledge of copyright is a shade short of stellar

In short, yes they can do something - stop using it. Depending on the nature of the image and the goods, also be wary of passing off.

At absolute worst case scenario for you, see Copyright, Designs and Patents Act 1988 s.177(1)(c).

No idea what the big deal is. If the product you're selling is bound to have the exact same description then go for it. I always use my own photo's though.

I tend to copy what I used from my previous listings and add anything that other people have put about theirs.

Basically, a hyrbrid of my own words and what other people have put.

Yeah, I think Ill remove the image (but its really good ) but will slightly change the description.. pretty sure I know the site they stole it off anyway so might hit back at them on that one

My gf did this and the owner of the listing reported it to Ebay and they cancelled her listing and she lost her fees.

I always copy somebody's completed listing................

Am also aware of OCUK being a shop, and not liking given names or links to other shops where you can buy the same items, possibly cheaper.
