I work in a family run retail business and we take cards.

However this situation keeps arriving in that the customer presenting the card is not the card holder i.e mr instead of mrs or vice versa, or totally different name altogether.

The excuse is always the same few like its my wifes card/duaghers/dads/neighbours/friends card.

I am i legally right in rejecting such cards?

You're legally right in rejecting anything you like. Why would this be any different?

Maybe im too soft but it seems harsh but rules are rules and its my inheritance to protect from fraud :D

You can refuse a sale for any reason you can think of, except for discriminatory reasons, of course.

You'll find that husbands and wives sharing their cards is very common, if the guy obviously has the same surname as the person on the card, then you could just let it slide, up to you though.

I think you may start running the risk of losing customers if you turn them away. It probably is their partners card.

Thats what concerns me but im sure on their account it states to be used by the account holder only.

If the pin matches the card then it shouldn't be a problem. And if there is (which is rare) the banks sort it out for you.

I used to work for a large retailer and a couple of times turned away customers using (what they claimed to be) their partner's credit cards. They gave me so much grief for doing so but if they wanted to share credit cards, they could have gotten a joint account.

I don't know about the legalities surrounding this though, I just acted on company policy. Its hard to enforce now though, having no contact with the card.

Whilst this isn't PC, you are taking money for your business, deal with the 1 in 100 problem later, most others would do this if it was their own business.

To be honest, if they know the pin all that you refusing them is going to do is result in the person going outside taking the money out at the ATM and coming back in and paying in cash...

Out of interest do joint account cards have mr&mrs written on them? Or is it only one name?

Most others wouldn't.

Except when the chargeback happens, gets investigated, then you lose your merchant account for knowingly letting fraud take place.

You are not knowingly.

If he lets the above go ahead knowingly that it isn't the persons card being used, then he is in knowledge of a fraudulent act which can happen in losing merchant accounts with the banks, if its investigated.

Which i dont want to happen as 70% of our transactions are completed via Cards.
