Xbox 360 and Windows 7 are to be banned in Germany

Germany needs to be careful how it treads here. They are really starting to bite the hands of the companies that make some of the countries most popular electronics.

have not read your links, but what you said is BULL. IE6 was a travesty, which ms have been putting right ever since. the problem was the sheer number of IT departments in pragmatic organisations that extended the shelf life of IE6 beyond reason.

What he is saying is the truth. IE7 and 8 were both **** in comparison to their competition. The argument about microsoft leading the way years ago is mute. They have not done anything good for browsers in years and regardless of IE7's merits when it was first released, it was microsofts browser for far too long when other manufacturers were making much better products.

IE6 hasn't been an issue for most web developers in years yet IE7 and 8 still are to this day. Most web developers don't even consider IE6 when talking about how bad MS browsers are.

Why is it ridiculous? Have you seen what is patented, single lines of code have been patented before.
I don't see how a line of code can be justified to be patented. Coding is really just maths used creatively, where do you think logical statements came from? Such as OR & AND? You do understand that algorithms existed before computers?
Yes you don't have to know any maths but logic is a subset of maths and it's used heavily in coding.

The same principle can be applied to pretty much any patent. They all rely on the laws of physics which ties in with maths.

I know what you are saying but but you are abstracting far too much. At what point do you stop. Every literary work is simply a collection of words so how can you protect the order they are in?

It's much different with code though, think how much work goes into a book and how much work goes into a line of code.
It's common sense anyway that you shouldn't copyright something that impedes on someone else who wants to do the same thing, which software patents do all the time. You couldn't copyright a sentence used all the time but you can do that with code for some reason.

German courts have jurisdiction in Germany, nowhere else. Presumably they are stricter on this sort of thing, seeing as this is where things are getting banned, whereas in other places not much seems to be happening

They don't protect a line of code that says:

if(2 == 1) print("error");

If you copied a paragraph from another book word for word and claimed it to be your own you could be taken to court. The clever use of the code to achieve a goal will be what is protected, not just a simple line.
 
Software patents are ridiculous. It's basically copyrighting maths.

Its *** for tat. Apple are trying to ban everything they can claim including retarded aspects like sliding to unlock, which was on freeware phone mods before the iphone was released. Motorola own a *LOT* of patents to do with codecs, 3g data handling...etc

Apple took motorola to court for using slide to unlock, all the while they have been using motorola's intellectual property in their own phones :o

Because the motorola patents are now considered essential for device use, motorola are bound to set a *fair* price for other companies to use. IE they cant say apple have to pay £300 per phone to use there patents, which would effectively end competition and apple as a company.

However, IIRC apple and microsoft so far havent paid motorola anything for the use of their patents. Hence motorola taking apple and microsoft to court. A US court is looking in to the situation and has blocked any ban in Germany for the time being. Really the court action is to force those using patents to pay, because otherwise this situation will continue, motorola wont get paid, nor will they force microsoft/apple to develop their own alternatives. I`m sure microsoft and apple will find further motorola misuse of their patents and the cycle will continue :(

Why does this stuff always happen in Germany? I heard some one once say that the defendant had to prove the innocence instead of the attacker proving guilt if that makes sense?
