As he doesn't say he bought it from OcUK I thought it best to advise him of the period allowed by law as other places aren't so generous.

"The item must not be used and must be 'as new' when returned to us" doesn't sound like OcUK.

Yeh soz got it from another place, Ocuk didnt have the WF at that time.

Is the VTX3d custom 7970 any good.

It looks good to me and has the extra adapters and things that make it worth it especially for under £370, however i feel that i may perform worse than the gigabyte card i have atm.

Yes VTX3D X-Editions are great cards. :)

Quick question for anyone with the knowledge - so as i quoted above in that retailers returns policy items must be "as new and not used", i've now put in a returns request, I've subsequently been asked to speak with management at some point tomorrow, I imagine they want to clarify why I'm asking for a refund. When i say 'yes i dont like its performance' they can easily refer to their policy and decline a refund, how do i handle this...

You don't have to give them a reason.

You're entitled to return it by law and that's the end of the matter.

There's nothing in the law that allows them to interrogate you to see if they can weazel out of it somehow.

If you want to give them a reason then just say you've changed your mind.

What i did do was take a piccy of every angle of the card inc the packing with a bit of paper with the rma number time and date just to cover me.

Great point, didnt think about doing that, i'll make sure to get out my slr get some extra detail in the pictures. £13 not bad, hows royal mail special like...

Also, VTX or Sapphire i'm thinking to go for. Will Overclockers deal with warranty through the duration or the manufacturer. I ask as I emailed OCuk and MSI cards for example are to be dealt with the manufacturer after first year.

+1, just say to them that under the distance selling regulations you have the right to cancel the contract with 7 working days and that you would like to exercise that right, don't mention whether or not it's been used as they can't impose that condtion under the law

make sure you've emailed them (as you need to notify in writing for it to stick under DSR - and you need a copy of when you sent it - most etailers RMA systems don't let you keep a copy exactly with date)

I've already sent a note through their RMA system that I'd like a refund under DSR. I did however mention there was no fault, which basically means 'i've tried it and it works'...and I cant see them not asking whether or not its working or not on the phone. I'll have to say yes.

You shouldn't really be discussing it with them at all.

There's nothing in the law that allows them to try and prevent you returning the card if you've made a proper request to return it under the DSR.

They have no choice but to accept it.

If they want to take issue after you've returned the card, say you sent it back damaged, then that's the time for them to do it.

It's a good reason for you to take lots of pictures recording the condition of the card and make sure you get good clear photographs including the serial number.

There's no requirement in the law for you to return it in "as new" condition.

The only requirement is that you take reasonable care of it.

Make sure you use a signed for method of delivery and follow their return instructions to the letter.

Getting into a conversation with them is only likely to end up with you saying something they may try and use against you.

Thats my fear, the call. But overall i've had good experiences with them in terms of rma and general customer service in the past, about 4 years ago, things could have changed.

Anyhow thanks again, i'll keep the convo with them short and take video and pictures just in case.

You need to email them too, you won't have a proper record if you've only used their rma system

You don't need to tell them anything on the phone, in fact don't even answer the phone, do everything by email and only tell them "I want to cancel the contract as per my rights under DSR"

Surely that is the proper way and email is just an email with no real record except on a support persons email list. Anyways they are a good company as i've said before so i dont see them making that much of a fuss, well thats the hope.

I will however, as you suggest email them and keep contact to that. Cheers.
