The contract is still running, if he used it or not, he owes the money. The best he can hope for is a goodwill gesture from the phone company.

He didn't cancel the contract, ergo, it is still running. It is not Orange's fault he didnt use the service he never bothered to cancel, in the manor he agreed to when he took the contract in the first place.

your world must be an amazing place. they signed a contract, they agreed to the terms and conditions, they pay for it. so if I took out a 24month contract, decided not to use my phone for 3 months in that 24month period and could prove I hadn't they should waiver the fee?

Im talking about AFTER the 24 months.

but the contract is still ongoing as that is what the T&Cs say, so in effect the same rules apply AFTER the 24months that do DURING the 24months as he is still under contract until he says otherwise with 30days notice normally.
 
if you ask for a reduction you will likely get it (especially if you haven't made use of the contract during that period). you will probably pay for 3 out of the 6 months
 
After the contract period most pay-monthtly phones rollover to being a rolling monthly contract. Don't know why it took them six months of not being paid to chase you though!

Did you port the number over from Orange to GiffGaff?

I didn't port the number, I just took out the old one on the date that I thought the contract had ended and cut it up and put it in the bin. I had a read at the smallprint on the orange website and you're all right about saying it goes onto a 30 day rolling contract. When I have some spare time i'll call them up and then i'll update this thread.

Found these clauses in the terms and conditions too:

termination of your Contract by Orange
4.5 We may terminate your Contract immediately at any time in respect of any or all the Devices owned by you, in whole or in part, by giving you written notice if:
4.5.1 you fail to pass any credit assessments which we may reasonably consider to be necessary from time to time,
4.5.2 you fail to pay any of your bills from Orange on time,
6 your responsibilities

when your payments are due
6.1 Ordinarily we will invoice you monthly in advance for monthly charges which are non-refundable and monthly in arrears for call and message charges but we reserve the right to amend the invoicing period and submit interim invoices to you. The Connection charge will be included on your first invoice. Charges in respect of Services not supplied directly by us e.g. Roaming may be invoiced several months in arrears. VAT will be added to all invoices at the relevant rate where applicable. Payment is due when you receive your invoice and/or it becomes available as an e-bill on Your Account.

I'll mention these when i call up. Considering it was a 30 day rolling contract it's surprising they kept renewing it when it hadn't been paid for 6 months :S
