Claiming compensation after being assaulted...

Hi all,

Has anyone claimed compensation following being assaulted before?

I'm wondering if it's better to go down the CICA route or through a third part/lawyer?

Any thoughts?

depends who assaulted you tbh, if it's just some chav head scum bag it's really not worth the hassle. You won't get anything even if goes your way.
 
Context is needed... There is no one-size-fits-all answer.


* Who assaulted you? Friend? Co-worker? Boss? Policeman? Random chav?

* What did this "assault" constitute? Punch in the face? Knee to the happy sac? Over-enthusiastic shove? Exposure to unpleasant music?

* Were there any witnesses? If not, do you have any evidence that the assault took place.

* And most importantly: Have you reported the assault to the police, and what action has been taken so far?


Assault being a criminal charge, I imagine it would be handled by the criminal justice system first and foremost. Once the assault charge has been proven and the subject convicted, you could consider suing (for example if you had suffered a loss of earnings from the assault etc).
 
You need to have a crime number - if you have been to the police and to the hospital there is a good chance you will get something. I know someone who got about 5 grand when some idiot knocked his teeth out.
 
To bother making any sort of claim you will either have to show tangible 'pain and discomfort' or a financial loss. If you have neither, then don't pursue it.

To give a bit of background.... I was assaulted by a man who was did some repairs on my car back in march, there was a dispute over the price and he kept hanging up the phone telling me to go down there so I did and got assaulted.

I got punched and kicked repeatedly in the face, back, arms and legs and I ended up with a hole in my lip, whiplash, and have reduced range of motion and ongoing pain in both my left elbow and right wrist.

It went to court last week and the guy who did it has been found guilty.

I would like to claim for loss of earnings for time I had to take off work, the clothes that were ruined during the assault, my phone that he damaged, the fact that I have ongoing injuries/pain and have had to go on anti-depressants since.

Man, I felt sorry for you at the time. I hope you hang him out to dry, he sounds like a proper scrote.

Jesus, all over a dispute at the garage? How rough is your area. Now i live in a 'bad' area but this wouldn't happen.

Id ring them injury lawyers etc. Did he not have to pay you anything from court, being found guilty?

When I got attacked many years ago outside my place of work, the police came along took my statement and my friends statement and took it from there. They knew who the guy was and he was eventually caught and he was made to pay compensation to myself and my friend (he smashed the windscreen on his car with his bare hands) via the court.

Hopefully that is what happens in your case to. I remember the thread as well, crazy how it escalated!

Yeah I had it deleted because it started getting to the point that people were prank calling the garage etc and I didn't think it was very productive lol

Yeah he is a complete **** the way him and his son stood up in court and just lied about the entire thing made me sick.
 
Contact CICA for this as that is what they are there for.

They will send you out a form asking you for as much detail as possible. Include the crime reference number on it.

After you send it back, CICA will send another form to the Police Force involved asking for the cop that dealt with the case to provide other details including their own personal description of events and any previous convictions you, as the applicant, may have as these may or may not influence the amount of compensation you may receive.

Given he was convicted, the chances of them paying out are very high.
 
Looks like you have a strong case for CICA, you would have to speak to some lawyers though to see who it is better to go through.
Also worth baring in mind that even if you win the case against the person who assaulted you, it could be a LOT of hassle actually getting the money out of him. So CICA should be easier

Seriously, don't bother with lawyers. Go and apply with CICA.
