Claiming compensation after being assaulted...

I applied for compensation through the NI office after an incident on a night out and they sent me out all the forms and a booklet. Right at the end of the booklet there was a list for all the different types of compensation injuries you could claim for. Lost sight (I think that was about 10k), lost limbs, spinal damage, right down to scaring. It worked on a points system for eligability. If you had too many points against you you weren't eligable for compensation. I had too many because I'd been to court a few times. Don't know if that's changed now, but I doubt it.

I believe that tbh, such a beating can really knock someone's confidence, as well as triggering emotional whirlwinds so anger/fear/anxiety/self berating for not handling it better.

I hope you can make a decent claim against them, even if they have to sell off the garage etc. to meet the payment.
 
I made a claim around 7 years ago after being the victim of a stabbing.

I was off work for around 10 weeks, but was unable to claim for loss of earnings as you needed to be off for 12 weeks before being eligable to claim. I did recieve a small sum for the distress and permenant scarring that resulted from the attack.
 
Sell your story to one of those rogue trader shows once all's done with in court. Cause the idiot as much grief as possible.
 
Can't comment on the path to take but as others have said I hope you get a result from this. Both in the sentencing for him and financially for yourself.

When my brother was assaulted he was awarded £300 compensation to be paid for by the perp, who was supposed to pay it back at some ridiculous rate like a fiver a week.

Suffice to say only the first payment was made and nothing more was ever received.

In hindsight we'd have not bothered involving the police and just dealt with it within the family, but it's too late once the police are aware of the assault.

In this case would it not be a court ordered payment?
If so I would report to the courts, if they get issued a court default its yet more going against them in life.
It may not get you the money but I would be doing everything possible to make their life take a bad turn, having court defaults on his record would potentially go against him in the future should he be after credit or even end up in court again.
 
Good luck mate, take him for all he's got.

As above one of those rogue trader shows too, make sure his name is tarnished and face known so he doesn't just start up again and do the same thing again, could be someones mum next time!

That's different than CICA. The court ordered this compensation.

Sounds like you've got a good chance then.
I often get letters from Solicitors on my desk regarding claims like this but our Trust Ministries department deal with 3rd party stuff so I sent them on.
 
Britain doesn't really do punitive damages. I can see you getting something for loss of earnings, maybe clothing and mobile phone. It's hard to associate ongoing pain with financial loss. Similarly with the antidepressants - can you show that you have suffered a financial loss as a consequence?

If you're hoping for a large cash payout because you're upset/injured, you're in the wrong country.

What was he found guilty of?
