Yes you are, you could sell the license.
But you're not able to.
No, you're not.

I suppose I'll go an preown my cable subscription then.
You wouldn't need to sell it back, you would sell it direct to other gamers, completely cutting the developer out.But they wouldn't need to sell it back on pre owned. It's a digital download so they can sell back on at full price but allow you to trade it back to them for discounts on other games
Subscription, not a single license.
Steam have a "subscription" service, but the model isn't a subscription based (Sure, you could say, you're subscribing to a game when you buy it for 999 years, but that's calling a shoe a fish)
Does your software degrade?
Yes you are, you could sell the license (Not physical product however)
But you're not able to.
If you want to put your case to the gov. on digital services, head over to the bis website and respond to their consultation.

That doesnt matter. but it does get older.
I can buy a piece of gold, that doesnt degrade either and im allowed to sell that on later.
There are loads of things that dont degrade that you can buy and sell...

The gold has the potential to be damaged etc.
The software will be as perfect as the day it was first purchased.
