No because he technically took her from the uk hence the arrest warrant for child abduction. He has committed an offence under uk law and will be extradited from France to our courts!

What if someone in Spain went on holiday to UK with a 13 year old girl, would that be fine in UK (so long as they didn't have sex until they landed on Spanish soil again)
Legally speaking he has actually committed child abduction due to her age of being under 16 (this applies in E&W). If she was 16 then he would have been fine.

Crime possible - Sexual Activity with a Child (section 9 SOA 2003) and Abuse of a position of trust (section 16 SOA 2003)
Also, it does not matter where the crime happened or the laws of the country it happened in. If the offender is a UK resident then he is treated as if the offence happened within the UK. This was brought in to stop people going to other countries e.g. Philippines and doing what they wanted due to their local laws.
This "statutory rape" thing that keeps getting flung about on these boards is just not correct. Statutory rape can only happen if the child is 12 and under, not under 16. 13-15 = Sexual Activity with a Child NOT Statutory Rape....

There is a specific part of the SOA 2003 that enables the prosecution of people from the UK if they committed an offence in contravention of SOA 2003 within another country as if they had committed it within the UK.

That's not possible unless he spent a year on remand!
6 year sentence since CJ act 2003 is automatic release at half way less time spent on remand. Sentences of 4 years or more means that person cannot be released before half way point on tagging.
