Missing girl 15, runs off with Maths teacher.

A teacher at my daughters school was jailed for 6 years for having sex with 3 pupils, he was out in a little over 2 so I'll be surprised if he gets more than that.

That's not possible unless he spent a year on remand!
6 year sentence since CJ act 2003 is automatic release at half way less time spent on remand. Sentences of 4 years or more means that person cannot be released before half way point on tagging.
 
As she is in France, is it 'fine' as the age of consent is 15? Then just wait until she turns 16 and return to UK

No because he technically took her from the uk hence the arrest warrant for child abduction. He has committed an offence under uk law and will be extradited from France to our courts!

What's the betting the consulate and soon her parents/social workers are busy telling her she was a victim of an evil man, that she doesn't love him and he never loved here etc. etc....?

Law is stupid, so at 15 its classed as child abduction, but if she turned 16 it would have been a holiday with an older guy :confused: :rolleyes:

What if someone in Spain went on holiday to UK with a 13 year old girl, would that be fine in UK (so long as they didn't have sex until they landed on Spanish soil again)
 
No, you are not missing anything. She went willingly so he did not abduct or take her. He can only really be tried for sex with a minor if that can be proven to have happened whilst in the UK.

At 15 they need her mothers permission, which they didn't have. Therefore it is child abduction.

If it's 16 he still would have been arrested and probably jailed, as he was in a position of trust (being her maths teacher).

No matter what he's the adult he should know better! I can't believe the amount of posters seem to think its ok to run off with a 15 year old!! He's a teacher and as such in a position of power, no matter what she did he is in the wrong!
 
If she was 16, do you think people would actually mind? Like would it be big news with an age gap that big etc, and is there anything legally that could have been done, im assuming he was in a position of trust being a maths teacher so he could get done for something i think even if she was 16.

Legally speaking he has actually committed child abduction due to her age of being under 16 (this applies in E&W). If she was 16 then he would have been fine.

Crime possible - Sexual Activity with a Child (section 9 SOA 2003) and Abuse of a position of trust (section 16 SOA 2003)

Also, it does not matter where the crime happened or the laws of the country it happened in. If the offender is a UK resident then he is treated as if the offence happened within the UK. This was brought in to stop people going to other countries e.g. Philippines and doing what they wanted due to their local laws.

This "statutory rape" thing that keeps getting flung about on these boards is just not correct. Statutory rape can only happen if the child is 12 and under, not under 16. 13-15 = Sexual Activity with a Child NOT Statutory Rape....

There is a specific part of the SOA 2003 that enables the prosecution of people from the UK if they committed an offence in contravention of SOA 2003 within another country as if they had committed it within the UK.

My apologies, I've just asked my daughter again and she now says it was a rumour that he had been released so probably untrue. This is the story here, makes this latest incident tame in comparison.
 
Suppose he deserves to go down for being that retarded he couldn't wait a few months until she was 16!

Spanish age of consent is a bit low isn't it - 13??
