How to report someone for misleading eBay advert?

I did a buy it now on the bay earlier for a iphone advertised with 9 months warranty left. Turns out it was replaced 3 months ago and the seller thought it would have a full 12 month warranty. So, after a few emails he confirmed there was less than 30 days warranty left and I decided not to continue with the deal as it was falsely advertised.

So, back on the bay an hour later and the same advert is there with no amendment to the warranty.

Normally not something I'd bother about but this dude is selling his refurb iPhone with less than a months warranty as a mint condition, 3 month old unit with a full 9 month warranty.

I've looked on the report item page but there's nothing directly for misleading descriptions. Any ideas?
 
So you bought the phone and then decided to ask questions about it? Maybe you should have asked before you decided to buy it like any other normal person?

I bought an iphone which was advertised CLEARLY as having 9 MONTHS WARRANTY. After the purchase I emailed the seller to ask if he would be OK with me collecting. While doing this I asked him for the serial number just to confirm the warranty, as any normal person would do. Once I entered the serial number it showed up the true remaining warranty. It was then he owned up to buying it nearly a year ago, stating that he thought replacement phones came with a full 12 month warranty.

In this situation the right thing to do is report the seller. Surely, if you were buying an item like this you would appreciate someone reporting it?

I guess this wouldn't be OcUK without someone trying to troll a legitimate post. Shame you life is that boring you have nothing better to do :)

Im sorry but you SHOULD have asked first, not buy the dam thing and then start asking for serial numbers and what not.

When it's advertised not only in the template as having 9 months warranty but in the user entered description as being a 3 month old phone, for a reasonable price there's nothing wrong with hitting the buy now. You're suggesting I should have emailed him prior to bidding when his listing has two entries stating the warranty? I may have used the buy it now feature but no payment would have been sent until the warranty had been confirmed. I'm within my rights to cancel, which I did.

The issue here is with a dishonest seller I'm trying to report, not what you think I should have done.

You're genuinely wasting your time and energy. And will only end up more frustrated when you do report the listing and see that eBay won't do anything about it and let it run.

Why should he have? If an item is clearly described as being 3 months old and having 9 months warranty remaining, why would you question that?

You're protected by eBay's rules on false advertising at this point so grabbing the item to ensure it doesn't get snapped up by someone else, and verifying the serial number before paying seems the smartest way to proceed to me.
 
The warranty term would have been void anyway. Look at 99% warranty terms & conditions and you'll find that it only covers the original purchase of the device. So selling it on to another individual voids the warranty.

its amazing how many people think that a replaced item extends their warranty to another year

Some companies will honour a full warranty term on replaced item. My TV developed a fault within warranty and was replaced. The replacement came with a note from the manufacturer with a new warranty expiry date.

Apples warranty is on the device and not with whoever initially bought it. When I decided to buy an iPhone my first call was to Apple to confirm this.


Update. The guy re-listed it straight away and it sold again soon afterwards. Around an hour ago I get an email from him asking if I will accept his sale cancellation request.

Would be nice if I could contact the new buyer to alert him.
