A sad end for the 200Sx

Well it is now offical, the 200 has now been delared a total loss by the insurance company. It was parked up outside my house on the road and a stupid old man decided not to pay attention to what he was doing and ploughed straight into the rear of my car.

Luckily he was insured and that he damaged his car so badly he couldnt leg it as his car needed to be recovered as well as mine as my car was causing an obstruction due to being spun around and the front pointing into the road slightly.

Im currently argueing with the insurance company with how much money I will be getting and they will be getting back to me tomorrow. Ive had the car since it was 3 years old and was the second owner and have had it for 9 years. In those nine years it hasnt let me down once, and has seen a few track days. A sad end to a fantastic car.

Amazing car, had 5 them and a s15. All well tuned. Bad craic, buy it back for cheap and break it on sxoc, you still have front end etc

Unfortunately I dont have any space to store a car for breaking which is unfortunate as it has a load of mods on it which would fetch quite a bit of cash.
 
Buy it back and sell it on for someone to collect it same day? Not sure if that's feasible. Sucks :(
 
gutted for you, sorry to hear that.

it doesnt have to be bad though. its not unreasonable for you to expect to be put back in the position you were to start with... ie them repair it or at least pay the cost to find another
 
As I consider it, one of the 'original' motors cars. A sad loss.

I remember us doing that trackday afternoon at Bedford together ages ago when I first had the S2000, the 200SX was fast ! Gutted to see its ended this way.

Was it insured with a guarenteed value/mods value?
 
Is it that bad it can't be used as a track day car or is the chassis knackered?

TBH I can't be bothered to fix it, and then maintain the insurance, VED, MOT etc just for a track car and I don't have anywhere to take it off the road. :(. Also I haven't been to see what the extent of the damage and I'm not sure I can be bothered to make the journey anyway.

The car was insured with mods and a like for like replacement for the mods, I'm not sure how that works out as its been written off though.

You have the right to be put back in the position you were before the claim. So they either fix it up to your satisfaction, or cut a cheque for the amount needed to buy another one of the same spec and standard. Simple as that.

Sorry to be thick but I haven't been through this before. If the cost to fix it is more than what they think it is worth i.e. book price then can they refuse to fix it and insist I take what they think its worth?

I know what you said, and the principle is simple but does it work like that in reality? I know these insurance companies are generally trying to pay out as little as possible.

You say yourself that it was insured with a like-for-like deal on the modifications and parts that it had, so I don't see how the third party's insurer can wriggle out of their obligation to you unless you give in and take a lower offer. If you need to involve your own insurer to get the other guys to play ball....well, that's part of what you pay them for!

That's my problem, the like for like parts agreement was with my insurer and not the third party. Is it possible to make the third party honour that agreement?

If I had smacked the car against the tree myself for instance, then I could get my insurance company to replace the parts like for like, I'm just not sure I could get a third party to pay for something they did not agree upon.

As you can see, I don't really know how it all works, I'm sure insurance companies prey on that ignorance as well.

They must put you back into the position you were in before their clients act of negligence.
