Paypal dispute - never done this before, should this be simple?

My g/f bought some hair products from a website. They were the wrong colour match for her hair. Having carefully read the terms and cons, it states that hair products can be returned if they are still sealed. These are still sealed. She notified the buyer on the day after receiving them via an RMA web form and also then emailed a few days later, and also called twice. Each time she got through on the phone it sounded like some poorly organised bloke running a website by himself. "Yeah I've sent you a return packet in the post give it a day or two." She phoned again and was told to wait a further two days. It became nearly 2 weeks since she bought them and this guy will not provide an RMA or address to return to.

So I opened a paypal dispute (never done this before) as it's for over £100 and I want these refunded.

I stated I just wanted a refund and he came back with comments saying they cannot be returned if they are a hair product due to hygeine reasons. This is despite that on his very site it says you can if sealed, which they are. He then kind of whined on about how he sent two packets for return to me and I received none. I have never in my life not received something that was posted to me. He put a comment like "buyer claims not to have received these packets" like I am lying.

The seller then raised this to a full paypal claim. Note that I (the buyer) did not do this, the seller did it himself despite that he is sitting with my money all paid.
It now says I may have to wait 10 days. I have not even been asked for any evidence or to put my side accross, only the seller has. I am concerned that the seller raised the dispute before me, almost like it locks me out for 10 days and he is trying to turn it around on me. He won't respond to emails now.
If I do finally get an RMA or return address I feel that the seller is going to just say they turned up opened or damaged or he will refuse delivery for them and will stitch me up.

Can anyone offer any advice here?

I thought paypal was meant to be biast to the buyer? I feel like this is going to cost me money and I'm hacked off at the mo with this as it's been two weeks, she's not happy as has no product for a do, and this seller I want to hunt down and punch in the face repeatedly.

I have his name and website but I'm not sure whether I should post this.
 
Also just noticed that in the terms it states there will be a 25% handling fee if a return is granted. Never saw this before. Right at the bottom. Is this legal under distance selling regs? We informed we wanted a refund/return well within 7 days, it's just dragged longer than this due to seller.
What a bout a chargeback? Is this worth persuing?

No, you will be intitled to a full refund.
 
Is the seller a shop or a private seller?

If private there's not really much you can do unfortunately, if they're a business, then provided you've requested the return within 7 days, the DSR should apply.
 
It is an online business with a website not a private individual, although he seems to act like an individual guy. There is a website but the more I look on there the more dodgey it looks.
The whois information provides "no address listed" other than a postcode in Oldham outside Manchester. But his address under "contact us" page says

Barker street
we are an online shop

With nothing else there.
 
Yes it will be simple, in my case last week it was the rocket that the company needed to pull their finger out. In your case even if you foot the bill for recorded postage you should get it refunded.

also you can phone paypal and ask them to put some notes on the dispute

if you have no luck with paypal (which i will be surprised if you dont)
you could possibly do a charge-back via your credit card?

paypal will ask you to post the items back with "tracked post" (USE SPECIAL DELIVERY OR IT WONT COUNT)

then once you give paypal the proof of delivery (via phone) they should grant you a refund
