How To Deal With This Accident ?

Last time I posted here it was regarding another bump, how ironic ! This time I must stress it wasn't my fault or actually the fault of the brother of mine that was driving.

I'm currently insured with Tesco Car Insurance, I'm 24 & have 3 Years No Claims, insured on the same policy as a named driver is my girlfriend aged 18 (yes she's young & quite a catch but that's another story) & my younger brother also of 18 years. Now call my crazy having such a set-up but they're both paying their larger share & I had trust in both of them, more fool me ! Excess is £700 each for the both of them, yikes eh ! We've only had the insurance since September & they've both only had their licences for 2 months.

Anyways, fast forward to today & we have a problem, my brother has been involved in an accident, a small one in some respects but I'm sure my car wouldn't agree.

It goes like this, my brother is pulling into a one way street & notices a car about to revers so he pulls into a parking space & waits, turns out this was a big mistake. This "care free lady driver" decided she'd like to reverse out of this one way street into the main road to avoid going all the way to the end, turns out she needed a bit of a swing to do so & as such scraped all down the side of my little car. :( The damage to my car is quite nasty looking & consists of multiple large scratches & one large dint half way along the scratches. Her car has one chunk missing from the corner of her front bumper missing caused by the friction of the scrape.

I have pictures of the damage which I'll post up later. The accident happened on the corner of this one way section, the one way half of prospect road where the BT exchange is.

The lady at blame admitted fault at the time of the accident but has since retraced that & laid blame on my brother leaving us with the only option of going through the insurance, turns out she is also insured via Tesco ! The accident happened around 1PM & my brother was due at work at 2 so we haven't had time yet to call the insurance to log a claim against her. We'll be making the call when he finishes at 7. She may have already called her insurers as she stated she would but I'm yet to hear anything.

There is a BT Exchange right where the accident happened which has CCTV cameras pointing roughly to where it all happened, we've been given a number to call about retrieving footage but I'm yet to give them a call. Do I call these myself or let the insurers deal with it ?

Anyways I'm simply here to ask if there is anything else I could be doing ? I'll post pictures up of the damage later.

Many may think your brothers inexperience will lead this to go only 1 way, in favour of the other driver. However, I had a crash 3 weeks after passing my test in my mams car. Old lady on the outside lane wanting to go all the way round the roundabout without indicating or attempting to move lanes, myself on the inside lane wishing to exit the roundabout. Needless to say she side swiped me.

Her husband in the passenger seats who was an experienced HGV driver blamed me, and it took 8-10 months in the end for me to get my excess money back and for the claim to be settled.

If I were you I would see if you can get the footage yourself, I'm not sure how long the BT exchange will keep hold of the footage, and sometimes insurance companies can be very slow about getting things in motion.
 
If she reversed along your car, she's at fault. If, however, she was reversing and your bro thought there was enough space to nip out of the space and head on his way, and subsequently went along the front side of her (taking the front bumper off in the process) then he's at fault.

All you can really do is call your insurance and hand over the details.
 
Thanks for the advice guys. I don't really have the full story yet as my brother was in a bit of a state. I'll be getting the full details from him soon & passing the phone over to him when the insurance ask for the details of the accident.

I've contacted the people in charge of the BT footage & they've asked me to send them an email asking for the footage pertaining to the time of the accident. I'm not sure if the camera covers that section of road but we shall see.
 
Reversing out of a one way street onto a main road is pretty bad driving let her make her claim I would be suprised if they find against your brother. As for the CCTV try and get hold of it ASAP and then let her know you have it, she may change her story pretty quickly.
 
If she tells Tesco she was reversing out of a one way street, wouldn't that mean she was driving contrary to the road traffic act? ie a ONE way street?

Totally agree. I wouldn't worry to be honest, sounds one way to me... No pun intended!

Was your brother and car completely stationery when she collided?
 
He was indeed stationary. The problem is she's decided to change her story & claims my brother drove past her while she was stationary. The pictures imo prove that story false but the stupid woman is just making things difficult should she give a false story when the insurers contact her.

Just waiting on my brother returning from work so I can get the pictures on the laptop & post em here. He's off to the police station on the way home even though I've told him they won't do anything. :/

I've been told to send an email to [email protected] to retrieve the CCTV Footage. Strange email address but that's what I was given.

As far as I am aware the highway code states it is illegal to reverse from a minor road into a major road. You can only reverse from a major into a minor.

Stick with things, even if it gets to talks of going to court. Hopefully the pictures your brother has will show him parked up and how the damage has occured.

My brother had an incident where the 3rd parties insurance company at first offered a 50/50 split which we said no to. Then it came back as 70/30 in my brothers favour, which we said no to. Then it was said it would be taken to court. I think it was about two weeks before court they admitted 100% liability. Insurance companies are scammers too it seems as the evidence provided didn't change at any point in time.

What were you doing on the inside lane of a roundabout if you wanted to take an exit??
 
Right made the phonecall to the insurers, was pretty short & sweet which was pretty pleasant. Got my brother to explain everything to them & they took details of the third party. She didn't ask for pictures of the damage or the details of the girl my brother had in the car at the time, I did inform them we have requested CCTV footage though.

We're entitled to a courtesy car & they've arranged for a local garage to fix the damage & they're going to contact me tomorrow. She mentioned on the phone that there's no excess to pay given the details of the accident but I'm guessing this could change dependent on what the third party tells them when they contact her ?

Unfortunately she moved her car damaging the car further before he could take pictures of the position the cars were in.

Guess we've got to play the waiting game now & hope the third party owns up when the insurance contact em.
 
She reversed into a stationary object, she is at fault.

There is no debate about the matter.

If you are ever in a position where its a tight squeeze to get through, or another vehicle is coming the other way down a narrow road and not leaving a lot of room, always stop.
Don't dither, don't try and get through, always stop.

That way, you are never at fault.
 
As soon as it happens, I'd whip out my phone and record where I am and what the other driver does.

Then you'd have proof you were in a parking bay etc. I hate people like this lady who lie about insurance claims, they are the reason I'm having to pay so much premium :|
 
Good luck with the CCTV footage, sounds like you've gotten a good response to the request - when I had a **** drive into me, I requested footage from the security company who had cameras all over the area (one pointing almost directly at my car), and they told me in no uncertain terms to politely do one. :(
 
If the lady is now saying that she was stationary and that your brother was moving, where exactly does she believe she was parked? That would be the question I would be asking.

From the pics, your brother must have been parked on the left hand side of the road. In order for the damage on her car as she claims, she must have been parked on the right of the road. You need to confirm if according to the road if what she's claiming even makes sense for that particular road.

Took the car to the nominated repair centre this morning, they've had a look & couldn't quite decide what they're going to do with it so they're gonna get some figures & get back to me to get it booked in, I have use of the car in the meantime.

I'm not sure exactly what she's claiming as I wasn't the one that got in touch with her after the accident. From what I gather she claims to have been stationary, assumidly parked up. If she decides to claim that, for that to even hold any ground she'd have to state she was on an angle to even cause such damage! My brother had entered that road seconds after her, a car up ahead of the lady had just been jump started but as she was impatient she decided to attempt reversing out swinging too much catching our car that was in a parking space to the left while she tempted to reverse.

I'm guessing she never looked twice when she reversed & as a result the accident happened. :/ I've heard back from BT Security & unfortunately the camera close by doesn't quite reach that far down the road so that's a no go. I'm guessing if she decides to lie through her teeth its her word against ours. I found her on facebook last night & decided to take a look to see if she'd posted anything about the accident & low & behold she had! She hasn't said much but she has mentioned reversing so I screen printed that. Not sure if it's any use but hey Ho.

I haven't heard Tesco yet so I'm unaware of any conflicting stories so it's just a waiting game here on out.

So she wasn't only attempting to reverse out of a one way street (in the wrong direction), but she was actually trying to swing the car around to leave the road front-on entirely the wrong way?
