Hi all, accident related thread...

Me and the Mrs driving in a 40mph zone into work 2-3 months ago... Guy infront driving 25 in a 40. A queue gathers behind us and you would expect, I take a look behind people are getting annoyed at us, I look at the guy infront and he starts shaking his hands at us? I then put my hands up in a confused mannor as in wtf is going on speed up if you don't like the queue kind of look, he then slows down to 10-15 in the 40mph... Window comes down he starts making hand gestures out the window at us , i put my hands up like wtf are you doing. While looking at his hands as couldn't tell if it was a "V sign" or a overtake us sign he slammed on... Mrs car kissed his Tow bar.... speed as mentioned was around 10MPH - no damage to his car and indent in the front grill (plastic) of her car. He then jumps out of the car threaten my Mrs (21) i jump out tell him to back off, which he rightly did to his car. From there he continued ranting and screening at us. So bad that bystanders started to record the incident and the guys rage, 3 people said dont rise to him call the police. He then started to walk at my Mrs with that look in his eyes, i suggested he stays away, the Mrs got out and walked over other side of road with a random women on the street, Reduced to tears at this point, I said to the guy "look what you have done what is your problem" He then said good im glad shes crying the stupid etc etc

At this point i said right im calling the police this is OOO his daughter jumped out (23-24) the car begin for us not to call the police.. "please dont call the police, its all his fault hes annoyed because hes had a fight with his son in law here's all our info" she gave address name etc etc...

Then they both jumped inc ar and wheelspun off.

I left it an hour and rung the number the left - the driver answered... Apologized for being "angry" but said it was all our fault still ?? said to him look im not going to argue with you ill just go to the police (i took the numbers of the witness's at the scene" Went to the police gave them all the info they said "what do you want us todo?" nice....

They said if no injurys then nothign todo with us go through insurance... With her being a young driver her excess is £400, I managed to get my mate to fill the indent for £100 and got a new grill for £120 and fitted myself. Thought no more of it - untill last night... Cops arrive at her house advising he is now sueing her for compensation?

They would not go into detail as to what the compo is for though, they advised wait for the paper work.... She is still to scared to drive in that area because of this guy - £220 down and now hes claiming compo!!!

Where do we stand now?

Have you still got the names & numbers of the witnesses ? If so you could start ringing around & building your defense. Would prob make the missus calm down a bit if you get a few people on her side.
 
Its probably a whiplash compensation claim.

Might need those witness details. Guy sounds like a nutter.

Yes - that was what I was thinking - I did have the foresight to keep a file with all his info and all the info from that day - mainly from similar threads on here!

If it is such a claim is that a cost to us? Does she loose her NCB?

In most cases going into the back of someone goes in the favour of the person in front. I can't see how you can spin this any way that would go in your favour.
 
So, in summary, you met a nutter and your girlfriend can't drive.

Might just be me, but i dont think this guy is a nutter. Think hes just a angry soul. Lets me honest if he was as much of a nutter he would'nt of backed of to his car when you got out would he?

My GF works at a soliciters like this and shes forever telling me if your shoved into the back its always the guys behind fault.

Seriously. She was behind someone driving erratically, so the decided to drive close enough to him to rear end him when he did something else erratic. Geat driving right there.

In answer to your question, if she or the other driver make a claim, yes she will lose her no claims discount... The clue is in the name...

And yes it will be deemed her fault. She crashed into the back of someone because she was too close / too slow to react.
 
All the witness's agree he broke for no reason other than to cause a accident, the police said there is a chance you could spin it... but im not that bothered on that to be honest ill let the insurance deal with that side - i was just wondering what happens... as in Does she loose NCB is there a excess that kind of thing
 
The guy is obviously a nutter. However, any collision where a car is rear ended is almost always the fault of the driver behind. The OP's GF should have kept a safe distance.

It seems odd that the police would show up about him claiming compensation, but wait for the paperwork, if anything materialises at all.

Did you manage to get contact details for any of the bystanders who could back up your side of the story? Ultimately, she did drive into the back of another car so the accident was her fault - if he does try to claim compensation then the best hope you have is for others to back up the speed and his erratic behaviour

NCB is reduced (the amount will be in the policy doc). I believe excess is only payable if you claim for repairs to your car.
