Accident :(

All the witness's agree he broke for no reason other than to cause a accident, the police said there is a chance you could spin it... but im not that bothered on that to be honest ill let the insurance deal with that side - i was just wondering what happens... as in Does she loose NCB is there a excess that kind of thing

His side of the story will go like this (either truthfully or not):

Driving along minding his own business
Car comes up fast behind him and tailgates
Passenger in car behind starts gesticulating angrily at him
He slows to aid them in overtaking
They don't overtake
He stops to let them past
They crash into him

Yea thats pretty much what he said - bar slows to over take, he suggested he slowed to ask us why we were making hand gestures at him, but again the witness says otherwise...
 
Don't be dense, this isn't a discussion about his training. If you want to talk about things like that I've provided a link.
 
If you hit someone who brakes from 10mph then you must be driving too close :( the fake whiplash claim (if that's what it is) stinks, but I can't see any way this will go in your favour.
 
Crashing/Bumping a car travelling at 10mph says either
a) your GF was driving too close
b) your GF's reaction times are poor
c) both of the above.

Sorry but that's how i see it.
 
Sounds like your have to take it on the chin, you were to close to the car in front and crashed into them so it's your fault regardless of what the idiot in front was doing.

You should have just gone around, or hung back as this guy sounds like he was looking for trouble.

You can try and fight it and it might get to 50/50 but you did hit the back of his car..
 
Any idea on reaction time and stopping distance at 10mph? Sounds like you were driving awfully close regardless of the other parties shenanigans.
 
Sadly despite the overwhelming possibility that the guy is a weapons grade idiot, it is your girlfriends fault. He stopped, she didn't.

If he had no reason to emergency stop and there are multiple witnesses, I fail to see how any blame is on the driver behind.

Because you should always be able to stop without hitting he car in front, regardless of reason.

He was already behaving erratically, that would have given me enough reason to leave MORE of a gap
 
not really - am cardio, pm weights & my physique and lifts say otherwise ;)

Just spoke to insurance - they said worst case is loose 1 yr NCB with no excess.

Sorted.
