Not getting a full refund. Can they do that?

Hi,

Ive ordered a pair of trainers from footlocker online and returned it within 7 days. The reason i put down, ordered wrong item.

The trainers cost 34.99 + 4.99 postage.

I only received 29.99 back. Taken £5 due to the reason. Can they do that?
 
When your order has been received back to our distribution center with the merchandise in a resalable condition, you will be refunded for the purchase price of your product. Your original shipping charges will only be refunded if the item was damaged, defective or shipped incorrectly. Your original form of payment for your purchase will be credited.

T&Cs clearly state you won't get back cost of shipping if you are returning for say wrong item etc.
 
No, you are protected under DSR and can return good ordered online for ANY reason from 7 working days since you received it.

However, if these trainers were modified in any way specifically for you (Nike once did a thing where you could have words printed on your shoes for example), you lose this right.
 
Doesn't matter, DSR overrides T&C.

Once again, it doesn't matter, the law doesn't state you only get a refund when the law is mentioned.

Fair enough, a polite email to the customer service department quoting the section in the DSR should see him straight.
 
Just got the phone, they are adamant no foul play. Manager isnt in until tomorrow. Will email them.
 
It is frankly shocking how many well known retailers flat out lie about the customers entitlement in what I assume is an attempt to discourage returns and/or deprive a customer of the legal rights they have when returning an item.

I can't remmeber the last time I ordered from a retailer who wasn't lying about return rights in the terms and conditions. Actually I can - OcUK have it correct in the T&C's.

We all know the DSR's are blatantly one-sided and arguably unfair on retailers but it remains the law and telling lies about it doesnt make it go away.

They are thieving, lying ******+ because they get away with it 90% of the time. Unless you challenge then they will continue with lies because the majority put up with it.
 
I have been a lurker in GD and the Motor forums for quite some time now and the knowledge you have Fox simply baffles me :)
