How To Deal With This Accident ?

sorry to hear this dude :( the whole thing stinks!!!

one of the things i suggest you sit down with your brother and go through this exactly... even go back down the street and get him to walk you through it. If from that you can decide it is the womans fault (i.e. your brother pulled into a space on the left, stopped, then she continued to reverse, went to turn around and swung the front of her car into yours whilst trying to do a reverse turn in the road/reverse round corner), then get on google maps, get a screen shot of the road/pics of the actual road and use paint or what ever to do a step by step what happened.

I did this when a woman drove out from a side street into the back of my car whilst i was stationary and tried to claim it was 50/50. the insurance company appreciated it as they could see exactly what i was describing then :) and had pics of the road to back it up/damage and sent it all in a zip file :D

technology wins again xD hopefully if it is as your brother says then it will all come off her insurance and our premiums won't go up much :)

Thank you kind for the advice, its appreciated. I intend to do as exactly as you say. I'll be knocking up a detailed statement of the accident & I shall include pictures of the damage, street view of the street, google map image & pictures of the space etc he was in at the time. Hopefully the statement will pick out holes in her story & give some credit to ours.

I'm not sure how it'll all be worked out anyways as we're both insured via Tesco, can't fight themselves can they.

Also judging by her facebook comment she seems to be in a rush, trying to pick up her (kid?), seeing a car "blocking" the road, impatiently reversing off the road. Plus looking at the damage of the car I'm finding it hard to see how your brothers action would have caused this, cos her damage is angled around the curve of the bumper which suggests she would have been in motion reversing unless she was stationed in an angle and your bro went pass.

If this means what I think it does then I'd be very careful of what else your brother says to this woman.
(I assume this to mean that he is taking advice off a load of forum "knobbers" i.e US!)

Why would she lie through her teeth on her own FB profile!!
Sounds to me like your brother and her have bent the truth somewhat!
 
Right, update time!

I've done everything I can, to date to explain everything as it was and to try and achieve a favorable outcome, as expected it didn't help! To fight my case I sent a 5 Page document and photos to them along with the completed accident report form they sent, this was sent a few days after the accident accident and I hadn't heard anything still. I received a phone call from them yesterday which I missed and this morning I received a letter from them.

As expected the claim has gone 50/50 and they advise that's the best possible outcome with respect to there been no witnesses. What more can I do? Not much it would seem.

Anyways I just called them to ask where we stand with regards to the excess & I was told it has been waived! I was also told the no claim discount had been awarded, I'm guessing that's just to with me sending them proof of my no claims upon taking out the policy though.

While far from how I wanting things to go I guess the lack of excess to pay is a bonus. It was my understanding we would have had to pay half but it would seem not in this case, quite unbelievable but this what I was told. Does it have something to do with both of us been insured via Tesco?

If there was excess payable I would have cancelled the claim. I guess the only problem is now I'll loose my no claims. :/

I'm gonna get on the phone to the repair centre & get it booked in now.

Good your not having to pay the excess, I can't help thinking neither have been open & honest about what really happened here imo.

Who knows? Only those involved I guess, I trust my brother but then I could never speak the truth for him. I'm just glad it's all pretty much sorted now, a re-think on insurance next year though I think !
 
Sounds like a fair outcome, at least your insurance side of things isn't buggered, don't let your bro loose on your wheels again! :p
