Not Trying to Claim Compo - Am I An Idiot?

Two days ago as I was picking my wife up from work I came to a complete stop in the middle of my lane while I waited to cross the lane of oncoming traffic and park up next to her building.

My car was been stationary for between 15 to 30 seconds when someone drove into the back of me, probably doing about 30mph as they didn't break, and didn't even try to drive around me. I don't know how they managed it and they couldn't offer any sort of explanation, all I can think is that they must have been texting or something as they had a good clear run up on what is a straight road before they hit me.

My 3 year old daughter was in the car with me and apart from a bump on the back of the head when it hit her car seat she is fine. My neck, shoulders and lower back are sore and I've had a headache for two days but at the time I told the insurance company that neither me nor my daughter were injured.

I've not had to take any time off work (desk job) and I'll probably be absolutely fine by next week but most of my friends and family are making me feel like an idiot for not trying to claim compensation.

To be honest I'd expect to have a sore neck and back after getting hit by a car and would feel like a fraud for trying to get money out of this, especially as my 3 year old is absolutely fine.

Everybody seems to know someone that has had x amount of pounds for similar and expect me to go for it but look at me as if I'm daft when I say there's really bugger all wrong with me that won't fix itself in a few days and therefore I don't think I'm entitled to claim for anything.

So, am I the idiot or does 95% of the people I know have questionable moral values?

Just claim, if you went into the back of someone, they would most likely claim off you.

end of the day you have suffered at the hands of someone else not paying attention.

No.

"Everyone else is claiming" is exactly why insurance premiums are so high.

And the op claiming is going to affect everyone's premiums how?

Times have changed and it's not going to change for the better regardless if he claims or not.

I knew I would be shot down instantly on here - posting this. :D

Nope, in fact they've already paid me money to get my daughter a new car seat.

Well there's no need to claim compensation then. Don't be part of the problem of this country's compo culture.

I've claimed it once because I was a passenger in a crash and was off work for a while, so I was financially at a loss. In this case, ignore the people telling you to claim with a smug sense of knowing you're a better person.

As humans we all end up suffering for various reasons but you don't expect compensation when you get a cold!

My friend had an accident over 2 years ago (rear ended at about 30 mph) and has been in pain ever since. Had countless appointments for treatment, tests etc but it's still an ongoing saga. He is about to get £10k paid into his account in compensation.

Morally I wouldn't if I wasn't injured.

Though, I would still claim as I'd go on the health and safety vibe of "OMG WHUT IF I WAS KILLED!:!ONE~!"

Of course you'll be shot down, most people around here are decent sensible people.

One person not claiming wont fix the problem, but there's absolutely no need to be part of the issue. I mean, you could commit just one small burglary - after all, everyone's doing it and one more wont change how much it happens...right? Not that I'm comparing the seriousness of burglary to bogus whiplash claims, but apply the principal to a more serious issue and it starts to make more sense

See that's a valid claim, sounds like he's been financially at a loss.

If that does end up happening to the OP (hopefully not!) then he can claim later down the line. It doesn't have to be done the minute you walk away from the car

By the way, before I get judged I have never claimed anything in my life.

I would give it a few days see how you feel, if you're* fine then don't bother.

If you claim when you dont need too,its basically because you are a ****

Cant believe some of the comment saying do it, Its fraud, and no different to being a benefit cheat imo

Not if everyone takes your 'well everyone else does it, so I will too' attitude to it, it won't, no.

As I said that attitude is set in stone now in this country and a few noble acts won't ever change this now.

Basically, You're not an idiot.
You're just not a complete ****

FACEPALM!

@OP the idea behind compensation is that the injury is causing you long term difficulty in every day life, rather than simply because you've been injured.

Generally people like to put in compensation claims as it's easy and very hard to disprove, and to "stick one" to the insurance companies.

I would let the insurance company know of the injuries of his neck & back etc, just in case further down the line these come to haunt him.

Just be glad you and your daughter are ok. Make sure their insurance sorts your car out and don't get fobbed off with a crappy punto while its being fixed. That is all reasonable IMO. Compensation won't be the quick easy payment people are saying it will be and if you've not suffered any financial loss then probably not worth the hassle let alone any moral stuff.
