Someone crashed into my car :(

Hi guys,

Basically a BMW 320d skidded down a hill, t-boned a Citroen Xsara Picasso which lost control, hitting the wall of my house spraying bricks all over the front my car.

The Beemer driver admitted full responsibility to everyone and the Police.

I rang up my insurance Admiral and because there were two cars involved, they said there could be questions raised about their liability. So to proceed with the claim they obviously wanted me to pay my own excess until liability is confirmed (£350).

As a result, I told them to jog on and would wait until liability is resolved.

Now what is my next move? Wait? Ring up their insurance? 3rd party claim company?

Hope everything get resolved quickly for you.

Personally i would be ringing the BMW drivers insurance and go from there. I would have done the same as you with your insurance, no way would i short pocket my self in this kind of situation.

When somebody destroyed my 106 years ago I went directly through his insurers for the whole thing. I called my insurers to tell them there had been an incident, but that I didn't want them to get involved.
 
The BMW driver has already admitted liability to yourself, the other driver and the police. I don't see what the issue could be. Your insurance company are just being dciks.

His insurance company aren't being dicks. The OP has a choice, he can go through his own insurance and get his car sorted ASAP and then recover the costs, or he can get them to chase the BMW driver which can take much longer as the other insurance company invariably drags their heels. That is if you can go after the BMW driver as said. IIRC (not stating this is fact) if you are in a line of traffic at a set of lights and someone at the rear of the line is rear ended and their car causes a shunt along the line of cars, you are supposed to claim off the car that shunted into you and not the person that caused the accident via the rear ending. I am guessing this is why doubts on liability arises.

Which route you take could depend on how damaged the car is and if you need to use it.

Albany assistance are providing me with a car and will recover costs from the other party. This normal?

Just hope the BMW driver doesnt change his mind because if he does Albany won't want to know from you any more.

These 3rd parties are like leeches on the insurance system and just make money off them by overcharging them for your hire car, and then skimming the profit off for themselves.

Indeed, I should be in a better position though as it will have to claim off one of the other drivers, seeing as I was in bed at the time!

No, his insurance company are acting as any insurer would. Until the money is recovered from another party, it is treated as a fault claim. This is how it works and is why you should never claim through your own insurer for something which obviously isn't your fault.
 
Yep. I'll just wait until another party admits liability.

Potentially stupid question, but with this accident I suppose I wont get my first years NCB? Had zero anyway...

You'll still get them.

You only lose them if it is your fault and you claim from your insurer if i remember correctly.

Unlucky :( But I can confirm these are indeed your pictures as the picasso crashed into a bin which happened to leave Hovis on display :D
 
Hope its not written off :(. Only done 50k, just had the '36k service', gearbox oil and thermostat change two days ago.

Needs new wings, bonnet, bumper, lights and grill...

N/S wing only needs a respray, doubt the insurance would do that though?

How about the wall... won't that have to be repaired as well?

The cost will also presumably be down to the BMW driver... or will it, as a clever lawyer could possibly argue that if the Citroen driver had (say) been more experienced, he could have avoided hitting the wall.
